RE Excavation Qty for Coppell Road SouthYes. The engineer sent me a memo and drawing showing how they calculated the 5,260 yards of channel excavation. When I looked at the drawing it was apparent to me that the calculation
was based on the drawing they had produced showing the extended pipe that we did not build. Upon further discussion with the engineer they are now in agreement with the quantity that
JRJ provided for our consideration.
We still have some things to discuss. As you know this item is a "Plans Quantity" which means under the contract we intended to pay for only that quantity listed in the bid tab. We
do this so we don't have to keep track of every yard of material. Of course no one expects the quantity to be off by 100%.
We want to be fair to JRJ, but we will need to negotiate this as a change order rather than over running the contract quantity. Please provide a cost for this work for our consideration.

I spoke with the engineer earlier. He advises me that there was a bust
in the excavation quantity. They calculate the channel excavation at
5,260 cubic yards.
They are reviewing these calculations and will send me a memo with their
findings.

We use Agtek to do our excavation takeoffs, it uses multiple cross
sections to calculate the quantities.
We would like to see what the engineers quantities were on both the
street and channel separately. As you can see, the channel itself is
more than the bid quantity which is what caught our attention when
tracking our completed quantities in house.

I'm not sure I follow the method used to calculate this quantity. I
have forwarded it to the engineer for review.
In the event we agree that the quantity in the plans is significantly
less than the actual quantity, how does JRJ propose to reconcile the
situation? This excavation quantity is a "Plans Quantity" item, and as
such we can not simply over run it.

We noticed that the qty of excavation was more then what was in the bid.
I have attached a takeoff on just the channel. The qty of excavation is
more than the bid qty. Again this is just the channel, when you add in
the qty of excavation for the roadway then the qty is even more off.

Have you had any further discussions with FWWR concerning these flagging
charges? They are now contacting our City Manager directly.
I am still holding invoice number 9 in the amount of $74,377.97. The
city does not intend to hold this invoice much longer, but we need to
have a resolution to this issue. If JRJ is not able to settle the issue
with FWWR by April 30, 2010 the city will withhold the $7,180 due from
this invoice, and process the balance for payment. The city will then
make payment to FWWR from project funds.
Please let me know by 4/30/10 whether you have come to an agreement with
the railroad.

It is my understanding that our contractor, JRJ, is obligated to pay for
the crossing reconstruction including the expenses associated with these
invoices which apparently pay someone $640/day to monitor the site for
trains that might require the clearing of construction workers. Keith
Marvin on our staff is th eprimary contact person. I also understand
that you or representatives of FWWR are having discussions regarding
this issue with JRJ. It is the City's intention to hold the contractor
to their obligation and pay for all costs associated with the crossing
reconstruction.
