Re: Eagle Point Village at Riverchase
Dear Kens
In conjunction with our development of the above referenced project
we secured two easements for off-site storm sewer lines from Golf
Enterprises. Both easements were granted in favor of the City of
Coppell and recorded by the Dallas County Clerk on January 27,
1993.
Both easements contain the following language:
"That in consideration of the benefits above set out,
Grantee will remove from the easement strip such fences,
buildings and other obstructions as may be found upon
said property."
Please be advised that to the extent that the above referenced
language implies responsibility or duty on the part of the City of
Coppell during initial construction, such responsibility or duty is
hereby accepted by Eagle Point Development, Ltd. and that Eagle
Point Development, Ltd. hereby holds the City of Coppell harmless
with respect to this language.
This activity will be completed byEagle Point Development, Ltd.,
or its agents, during the construction of drainage improvements
currently being installed as a part of the development of Eagle
Point Village.
