RE: Drainage Easements: Eagle Point Subdivision/Fairways Riverchase Subdivision
Dear Mr. Ragsdale:
As we discussed on March 1, 1993, I have received the fried offsite drainage easements.
However, I did have a concern that the easements stated that the grantee i.e., City of Coppell,
will remove from the easements such things as fences, buildings and other obstructions and that
the grantee will return the surface of the easement to it's original condition. As you and I
discussed, obviously the City will not be doing any improvements on the drainage easements
either before, during or after the construction of the facility. I have discussed the wording in
these easements with our City Attorney. His recommendation was that the City obtain a Hold
Harmless Agreement alleviating us of that responsibility and assigning the responsibility to some
other party i.e., the owner of the property or the developer of the property.
