Central Expressway, Stc. 300 Dallas, TX 75231 RE: Eagle Point Village at Riverchase Dear Mr. Daniel: I have received and reviewed your letter concerning the ponding of water along the rear of the north line of Block A of the Eagle Point project. The reasoning given for the ditch, along the north side of this property, is to save the row of mature trees along the property line. There are several questions and concerns related to this concept: 1) 2) On whose property will the ditch ultimately be and who will assume thc maintenance of this ditch? This could be a long term maintenance problem incurred by the property owners and, at some point in the future, the City. The property owner to the north, Mr. Johnny Thompson, has been in contact with me and has stated that it was his opinion that the trees along the common property line were either dead or dying and that when they developed their property, they may wish to fill in the ditch. There needs to be some mutual agreement and understanding worked out between this property owner and the property owner to the north, prior to final approval of the Eagle Point Village at Riverchase construction plans. Whatever is worked out between the property owners will have to include the long term maintenance of this ditch area.
