You correctly pointed out that there will be pending of water along the rear of these lots in the event of a 100-year flood in the Elm Fork, The same situation will occur with our design condition, which is a 100-year local storm when the River is experiencing a 10-year flood. The reason behind our design is our client's desire to save the row of mature trees along the property line. These trees are at the original ground elevation prior to the filling of both adjoining tracts. It is our client's view that it is more desirable to retain these trees within a narrow flood plain area than to have treeless lots free of flood plain. None of this has any affect on the potential for flooding in excess of the finished floor elevations of the homes on these lots. I would also point out that there is nothing inherently unacceptable or even unusual about a platted lot being partly in the flood plain, as long as its presence is noted on the plat.
