If you remember when we met onsite on 4/12, I believe it was, and there
was one lot that Yancey was not agreeing to which was the one on the
corner. All of the other lots he said he was good with but he wanted to
run it by Drees. That lot was fixed that same day and we did not hear
back from Yancey for another week where he came back and said Drees was
not accepting. These lots were corrected the next day after getting a
response from him.
The contract is to get acceptance from the Developer not the builder,
Yancey was accepting of these lots other than 1R which was fixed on the
12th. I do not see where I can be held accountable for the delay of
Yancey getting back a week later in reducing my bonus unless he wants
to
cover the cost of these delays. We fixed the other five or six lots
within four hours the next day so all of this could have been fixed on
the 12th or 13th had we known this was an issue. In fact I received a
call from Glenn Engineering saying they indeed did shoot grade in the
swales on the lot lines and not on the pads except the one shot in the
middle they took.
We missed the one day of the bonus due to KCK not having all their
items
corrected until the 13th. Had we been told by Yancey, the Developer, he
was not accepting the lots we would have fixed them that day. As what
he
said was he was happy with them and for us not to touch them unless
Drees disapproved. When he said that we waited on him to respond before
we did anything else so how can you hold up our bonus based on these
facts.

Marty,
I'm concerned about this incentive. Is it correct that these lots were
not acceptable until the 19th? If so, would that not be 43 days of
bonus?
