RE Landscape Buffer Easements (2)I instructed Mike to have the surveyor prepare exhibits, i.e., drawing
and legal description. His surveyor used the phrase “easement” which is
not correct and not at all what I requested (par for the course).
To Keith’s point, I agree it makes sense to indicate the area on the
plat with whatever label the City wants to use. If Kevin wants a note
on the plat, we are running out of time.
It makes us no difference.

This is what we were talking about in the meeting yesterday. He is in
Oklahoma for a death in his family. He said he would do this as soon as
he gets back, but it obviously won't make the April 24th Council
meeting. I told him that it has to be on the first meeting in May.
We never talked about an easement. Kevin asked for an exhibit to show
where we were talking about because it was too hard to describe the
exact area. He preferred to reference the area by exhibit. I guess the
survey describes the boundaries so if we would rather use the metes and
bounds than an exhibit, but it was never suppose to be an easement.
Where did Mike get the instructions to do an easement?

Greg,
I'm not sure I understand this approach. The city does not generally
dedicate easements within our street right of way. We discussed
handling this through an amendment to our agreement. If that doesn't
work, we would prefer a license agreement to an easement.
I also don't understand why we would not show the easement on the plat
that is currently in the process. This would be a simpler approach.
If I'm missing part of the picture, please let me know.
