The drawings of the development show the fill and the lots, but nothing on the channel. There's not much left, so it's pretty clear where the channel has to go, but no centerline, section,
or profile has been developed, as I understand it, from conversations with Mike and Richard. Similarly, nothing definitive has been done with wetland delineation. The map that was provided
is from a national database and isn't sufficient for the Corps on any 404 issue. Both the planned fill and any channel work will need some level of on the ground delineation, which I
understand has not been done. Richard or Mike can correct that if I've misstated anything.
As a clarification, any excavation in a "waters of the US" by a backhoe is legal, but placing the fill you just cut out is not. You can tell a long line of court cases have drawn a fine
line of precedents to get that. So, yes the cut can be done, but unless the dirt is hauled off or we know where the wetlands are to avoid them with the placement of the fill, we'd have
to get a delineation.
Irving said they don't need to approve anything, but would like to get copied on the information.
Michael and I are working on a couple of options, but the "rough cut" option is not a simple one due to permitting issues. His channel option is problematic unless the stage 2 fill is
delayed.

The cad drawings for the channel alignment have been provided by BBCPI which I thought Keith was going to superimpose on your aerial. Was I mistaken on this or do you still need the

After checking our files, Mike Boyd & Richard Arvizu have previously provided all the wetlands info that we currently have. From those sketches, it does appear that the proposed channel
could possibly touch the wetlands in two distinct spots. However, if John Rutledge is correct about it being okay to dig in a wetlands with a backhoe rather than a dozer, this shouldn't
be an insurmountable problem.
Assuming that you, Dallas and TCEQ are all now okay with your dewatering plan, what will the City of Irving need for their approvals and how quickly do you think the work can proceed?
