Box 478 Coppell, Texas 75019 Subject: First Amendment to Development and Maintenance Agreement dated March 28, 1995 by and between The City of Coppell, Texas and WPC - Parkway Development Corporation Dear Mike: Please let this letter serve as an amendment to the existing Development and Maintenance Agreement as it pertains specifically to the following: For the earthen slope which is to be established with grass by hydro- mulch within "Area B" on the Development Map, W'PC - Parkway Development Corporation hereby agrees to retain maintenance responsibilities until June 30, 1996. Prior to June 30, 1996, WPC - Parkway Development Corporation will maintain the slope and will establish bermuda grass by either hydro-mulch or seeding prior to The City of Coppell assuming maintenance of this area. In conjunction with the establishment of bermuda grass in this area, WPC - Parkway Development Corporation will ensure that a slope of no greater than 3 to 1 be established and maintained along the entire area.
