Re: Failing Retaining Walls/Enclaves on the Parkway
Your Letter of October 10, 1996
Dear Mr. Martin,
Thank you for your letter dated October 10, 1996. Continuing in the spirit in
which the Development and Maintenance Agreement was made, we intend to
resolve the retaining wall failure as quickly as possible. However, there are a
couple of questions which need to be answered and comments which need to be
made:
1) It appears from my inspection that water has been allowed to get
behind the wall in a couple of locations. I think this relates to
maintenance of the slope more than to installation.
2) There is no clear date that I can find specifying the date of final
acceptance by the city. It should logically follow that date on
which Certificates of Occupancy were released t0r Huntington
Homes which dates back to approximately February/March
1996. I would suggest March 1, 1996 as the date of final
acceptance by the city.
3) We are currently arranging repair to take place by the original
contractor, Giles Masonry. We will be asking him to post an
eighteen month bond upon completion of the repairs in an
amount equal to 50% of the', original contract amount and in
accordance with the City of Coppell requirements for
maintenance bonds for public !improvements.
