However, the nearby Taco Bell site was subdivided from the total property in 1995. TRANSPORTATION: Denton Tap Road is an improved six-lane divided thoroughfare (P6D) contained within a 100'-wide right-of-way. Item # 8 SURROUNDING LAND USE & ZONING: North - South - East West vacant; "C" Commercial shopping center; "C" Commercial and "C-SUP" Commercial, Special Use Permit vacant and Taco Bell; "C" Commercial and "C-SUP" Commercial, Special Use Permit single-family residential development; "SF-12" Single Family-12 COMPREHENSIVE PLAN: The Comprehensive Plan shows the property suitable for neighborhood retail. DISCUSSION: This is a final plat for Lot 1, the tract of property for the proposed 50,000 square foot gymnasium, the common area (landscaped island labeled Lot~ 1X) and the North Texas Court right-of-way. The configuration of the North Texas Court has been altered at the intersection at Denton Tap Road from the preliminary plat in order to maintain its current access point on Denton Tap. Currently, Taco Bell has an off-site access driveway/firelane easement which will be abandoned with this plat. The applicant has completed a tree preservation plan and it showed that there is a 12" caliper pecan tree on the property which is worth preserving. The tree is located in a planter island adjacent to the northern property line. However, the 9' x 17' planter island is not large enough to accommodate a tree of such size. Staff is of the opinion that every effort should be made to preserve the tree, and it could be accomplished by enlarging the size of the planting island. On September 11, 1997 the Board of Adjustment unanimously granted the applicant's request for a special exception to reduce the required number of parking spaces from the required 333 to 116. The applicant explained the majority of the patrons of this facility would be picked up and dropped-off. On occasion, for special events such as tournaments, the demand for parking would be greater and there may be some overflow parking into the Connell/Skaggs property to the south. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Planning staff recommends approval of the final plat subject to the following conditions: 1) Enlarge the size of the planter island to accommodate the 12" caliper pecan tree. 2) Construction of a concrete sidewalk along the north side of ~e Item # 8 Taco Bell property line, a temporary sidewalk along the north property line of Lot 4 (designation on preliminary plat), and a concrete sidewalk connecting the Lot 4 temporary sidewalk to the building site on Lot 5 (designated Lot ! on final plat). Construction of sidewalks on Lots 1, 2, 3 (designation on preliminary plat),, as well as the permanent sidewalks on Lot 4 shall occur as those individual lots are developed. 3) Compliance with Engineering comments.
