of Sandy Lake Road and East of McArthur Blvc[ in the Elm Fork of the Trinity River Floodplain in
Coppell, Texas.
Dear Mr. Griffen:
We are pleased to submit this proposal for preparation oft. he subject study in order to det~amine the required
storage compensation needed to fill the site one foot above the 100 year floodplain as currently in effect. We
understand that the storage compensation allows a 15% reduction in 100-year flood storage and a 20%
reduction in the Standard Project Flood (SPF).
We will prepare a report describing the results, and necessary coordination to describe our findings.
The following is included in the scope of services for this project:
SCOPE OF SERVICES
Freese and Nichols will render the following professional services shown by task below in connection with
the development of the Project:
Task 1 Data Collection
1. FEMA information will be obtained.
2. Previous reports completed for this area will be review{x[
3. A site visit will be made to determine hydrologic and hydraulic conditions and parameters.
4. City specific requirements will be coordinated.
5. We assume no survey information will be necdec[
Tasi~ 2 Storage Computation Analyses
1. Develop cross sections through the site and set 100-year and SPF elevations for the existing site and the
proposed site.
2. Complete a HEC2 model of using the above data.
3. Compare the volumes determined to find the storage data required.
Task 3 Reports
Prepare a report explaining the methodology and results of the study, and containing appropriate charts,

graphs, plots, drawings and computer printouts to cle~ril~ the study.
Task 4 Coordination
Provide necessary Coordination with the city to describe the report and address techni~ questions.
BASIS OF PROPOSAL
Stipulations
The following stipulations apply to the scope of services of this proposal:
1. Construction Plans or specifications are not mch~__ed
2. Corps of Engineers Wetlands Permits is not included
3. Texas Natural Rcso~ Conservation Commission Approvals or Water Impoundment Permits are
not included
4. Field Surveys are not included
5. Review fees of any ldnd from city, state, federal or other sources will bc paid by the client and are not
included in this proposal
6. Additional designs not spec~c~y addressed in this scope of services are not incJ,ded
7. Storm-drains and other nm-floodplain considerations am not part of this study
8. To the maximum extent permitted by law, the client agrees to limit the engineer's hability strictly to
the technical area of this proposal, which is surface water open channel hydrologic and hydraulics
analysis. The client agrees to be liable for his or her own attorney fees.
9. Environmental Protection Agency or other agency approvals or submittals not specified in the above
scope of services are not included
10. Public Meetings are not included
11. Court appearance, deposition or any other involvement in litigation is not included
12. Client will provide any required compaction certification.
13. As-Built certification or FEMA submittals are not included
14. Additional services relating to unpenifitted fill, hazardous waste, and any other environmental
consideration are not ineludecL Wetland impacts require a Corps of Engineers' approval. With rare
exceptions, wetlands exist within floodplains. It is clearly understood that any wetland involvement
relating to this project will be addressed by others and is not incl,d_~l in our scope of services.
15. Without the benefit of a tree survey or direction from the developer we will not prepare our study to
eliminate loss of trees.
16. Design or analysis of the structural elements existing or proposed in this project is not part of this
study. We assume that these were analyzed and built correctly. This analysis is not within our area
of expertise.
TIME OF COMPLETION
Freese and Nichols is authorized to cocfuiience work on the Project upon execution of this Agreement and
agrees to complete the..s~viees identified by or before November 17, 2000.
ffFreese and Nichols' services are delayed thro~_~gh no fault of Freese and Nichols, Freese and Nichols shall
be entitled to equitable adjustment of eoaipensation and Freese and Nichols shall be entitled to adjust contract
schedule consistent with the number of days of delay.
RESPONSIBILITIES OF OWNER
OWNER shall perform the following in a timely manner so as not to delay the services of Freese and Nichols:

Designate in writing a person to act as the Owner's representative with respect to the services to be
rendered under this Agreement Such person shall have contract authority to transmit instructions,

recoiv¢ information, interpret and define the owner's policies and decisions with respect to Freese and
Nichols's services for the Project.
Provide all criteria and full information as to the owner's requh-~ents for the Project, including
design objectives and constraints, space, capacity and l~rformancx requh-e, aiants, flexibility and
expandability, and any budgetary limitations; and furnish copies of all design and construction
standards which the owner will require to be included in the plans and spedficatlons.
Assist Frees¢ and Nichols by placing at Freese and Nichols's disposal all available information
pertinent to the Project incb~irig previous reports and amd other data relative to the Project.
Arrange for ac, c~s to and make all provisions for Freese and Nichols to rater upon public and private
property as required for Freese and Nichols to perform services under this Agreement.
Examine all studies, reports, sketches, drawings, specifications, proposals and other documents
pre~nted by Freese and Nichols, obtain advic~ of an attorney, insuranc~ counselor and other
consultants as The OWNER deems appropriate for such examination and render in writing decisions
pertaining thereto within a reasonable time so as not to delay the servi~ of Freese and Nichols.
The OWNER shall make or an'ange to have made all subsurface investigations, including, but not
limited, to borings, test pits, soil resistivity surveys, and other subsurfac~ explorations. The OWNER
shall also make or arrange to have made the ~terpretations of data and re~rm resulting from such
investigations. All costs associated with such investigations shall be paid by The OWNER.
Provide such aecountmg, independent cost esl~natmg and insurance counseling services as may be
required for the Project, such legal services as The OWNER may require or Freese and Nichols may
reasonably request with regard to legal issues pertaining to the Project.

COMPENSATION
Basic Service: Compensation to FNI for the Basic Services shall be based on hourly rate with a
maximum not to exceed $1000.00. IfFNI sees the Scope of Services changing so that additional
services are needed, including but not limited to those services described as Additional Services, FNI
will notify OWNER for approval before proceeding. Additional Services shall be computed based
on the Schedule of Charges.

directly related to the work, including costs of laboratory analysis, tests, and other work required to be done by independent
persons other than ,staff members.
