HEARING DATE: April 16, 1998 May 12, 1998 LOCATION: Along the north side of Sandy Lake Road and along the west side of Cascade Way. SIZE OF AREA: Approximately 3 acres (8 residential lots). CURRENT ZONING: SF-9 (Single Family-9). REQUEST: Preliminary Plat approval. TRANSPORTATION: Sandy Lake Road is a two-lane asphalt road within a variable-width right-of-way, shown on the thoroughfare plan as a C4D four-lane divided collector street to be built within a 110'-wide right-of-way. Cascade Way is a residential street contained in 60 feet of right-of- way. SURROUNDING LAND USE & ZONING: North- Waterside Estates, No. South - East- West - 1 residential subdivision; "SF-9' Single Family-9 Woodridge Section Five residential subdivision; "PD-145' Planned Development, Residential Fountain Park residential subdivision; "PD-SF-7" Planned Development, Single Family-7 Meadows, Section Two residential subdivision, "SF-9' Single Family -9 Item//9 COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for medium residential density use. DISCUSSION: The average lot size for this subdivision is 18,687 square feet, considerably larger than the neighboring SF-7 and SF-9 lots, measuring between 7,000 and 9,000 square feet. All eight lots will take alley access off the existing alley behind Lots 6-17, Block F in the Meadows, Section Two residential subdivision. The two single family homes on Lot 8, adjacent to Sandy Lake Road, will be torn down and access to Sandy Lake Road will be sealed off with a 6 foot high brick screening wall. The proposed wall will match the existing Fountain Park, Phase One wall. Adjacent to the screening wall, along Sandy Lake Road, is a 15' wide utility, landscape and sidewalk easement which will be maintained by the Homeowners Association. According to the tree survey submitted by the applicant, the site has a number of trees. The applicant is proposing a rock retaining wall across the front of Lots 1-8, Block D in an attempt to save as many of the trees on each of the lots. Staff's major concern is with the location of the retaining wall. It is shown to be located in the street right-of-way of Cascade Way and needs to be there to keep from disturbing the tree roots. Ordinarily, the city does not allow private improvements in public right-of-way. In this case, however, the street right-of-way is 10 feet wider than necessary. Therefore, the applicant could propose to enter into a right-of-way use agreement with the City. The document would have to be reviewed by the City Attorney and approved by City Council. In addition, to the applicant's tree preservation efforts, staff requests the following trees be preserved: Lot 1, Block D: 36" Oak tree; Lot 4, Block D: 30" Pecan tree; Lot 8, Block D: 30" Sycamore tree; Common Area: 15" Pecan tree and 36" Hackberry tree. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends approval of the preliminary plat subject to the following conditions being met: 1) Provide a copy of the Homeowners Association Agreement for City Attorney review. 2) Furnish a right-of-way use agreement for the proposed retaining wall along Cascade Way for City Attorney review and City Council approval. 3) Preserve the following trees: a) Lot 1, Block D: 36" Oak tree; b) Lot 4, Block D: 30" Pecan tree; c) LOt 8, Block D: 30" Sycamore tree; d) Common Area: 15" Pecan tree and 36" Hackberry tree Item# 9 4) 5) The proposed rock retaining wall across the front of the lots needs to be located outside of the right-of-way, or a Right-of-Way Use Agreement must be approved by City Council. The ownership and maintenance of the wall would be the responsibility of the Homeowner's Association. (see Engineering comments) The Mexican Plum tree shown on the Landscape Plan must be a 3" caliper tree at the time of planting.
