Yes, I believe that this is due to a construction problem and they
should be responsible for the cos of the fix.

The wing wall was constructed approximately 2 inches to low.
The Top of the wing wall would be that much below the edge of the
sidewalk. The railing could be constructed on top of the wing wall as
it now is by making the posts of the railing that much taller leaving a
relatively minor negative visual effect. The contractor objected to
this option.
We have checked the elevations shown in the plans for this wing
wall and they appear to be correct.
