We will proceed with the review and get you a response for this CDC submittal by February 17 at the latest. For
housekeeping purposes, can you please provide email authorization for $750 for the CDC review?
Also,
Per the City’s Floodplain Ordinance Article 3, Section A: “Projects which have received a CLOMR from FEMA, but
have not begun reclamation, shall be considered by the City solely on the basis of regulations in effect at the time
of the issuance of the CLOMR, provided that the reclamation begins within two years of the date of the CLOMR. If
the reclamation does not begin within two years, the initial CLOMR will be ruled invalid and a new CLOMR will be
required from FEMA that is in compliance with this ordinance.”
o Has 2 years passed since the CLOMR’s issuance? If it has, does the City plan to enforce a new CLOMR
be prepared for this project?
Secondly, the improvements along Denton Creek have changed since the previous submittal, including relocation
of a proposed bridge crossing along Denton Creek.
o FYI – Our CDC comment letter will include a comment that requests an updated Denton Creek hydraulic
analysis for these modifications.
Please let us know your thoughts on the updated CLOMR submittal requirement.

I’ve gone through our records regarding reviews for this property. It appears we’ve done three reviews for a CLOMR and
CDC submittal:
We submitted a comment letter dated 1/28/13.
We submitted a comment letter dated 3/13/13.
We submitted a comment letter dated 6/11/13 where we recommended approval for both studies.
This exceeds the number of reviews specified in our contract. I need to pull the original submittals out of archive so I can
determine the revisions associated with this submittal. Assuming it’s a minor change I would think this fits under our $750
per review for additional reviews. If the changes are significant, we would likely need a new CLOMR as well and may
consider this a new submittal.
