Re: Property west of Ledbetter Road and south of Belt Line Road
Dear Sir:
It has recently been brought to my attention that a substantial amount of fill dirt has been placed on portions of
your property. It appears the fill has been placed west of what has is referred to as Ledbetter Road and south of
Belt Line Road. It also appears fill has been placed into a natural draw area, which has the characteristics of a
Wetlands Area.
Please be advised that the property on which this fill is being placed is within a designated floodplain area and as
such any placement of fill on the property is a violation of the City of Coppell's Floodplain Ordinance #94-639.
That ordinance specifically states that a Floodplain Development Permit must be obtained prior to the placement
of any fill within the floodplain. The ordinance goes on to state that a Floodplain Development Permit cannot be
issued until such time as all approvals are obtained from FEMA, i.e., a Conditional Letter of Map
Revision(CLOMR). Another approval required prior to the issuance of a Floodplain Development Permit is a
wetland determination from the U.S. Army Corps of Engineers.
A floodplain study was submitted to this office approximately I year ago, however a check was not provided for
the processing of the study for review. Therefore, the study has not been sent to our consultant for review. Several
inquiries were made of Ron Morrison as to the status of the check and my understanding was that each time he
conveyed to the property owner that a check was required prior to processing of the study.
At this time all filling should cease and desist. Also, any storage of materials or equipment within the floodplain
should cease and desist and all fill material placed within the floodplain should be removed. Penalties for non-
compliance with the City of Coppell's Floodplain Management Ordinance is as follows: "Any person who violates
this ordinance or fails to comply with any of ifs requirements shall upon conviction thereof be fined not more than
$500 for each violation, be required to correct or remove the non-compliance, and each and every day such
violation is continued shall constitute a new and separate violation. Nothing heroin contained shall prevent the
City from taking such other lawful action as is necessary to prevent or remedy any violation." All fill material
placed on this site should be removed by November 10, 2000. This is approximately thirty days. However, you
should contact my office immediately concerning this fill and the process for rectifying this violation of the City of
