are areas of nonconformance with accessibility standards adopted by the Texas Department of Licensing
and Regulation for purposes of ensuring compliance with Texas Government Code,Chapter 469.
Although deficiencies may have been noted, the referenced project may be eligible for inspection
approval if constructed in accordance with the Texas Accessibility Standards. Items which are the
responsibility of the owner should be referred to the appropriate person for action. The building or facility

CHAPTER 2: SCOPING REQUIREMENTS

201.1 Scope.
All areas of newly designed and newly constructed buildings and facilities and altered
portions of existing buildings and facilities shall comply with these requirements.
These standards apply to fixed or built-in elements of buildings, structures, site
improvements, and pedestrian routes or vehicular ways located on a site. Unless
specifically stated otherwise, advisory notes and figures explain or illustrate the
requirements of the standards; they do not establish enforceable requirements.
The standards for determining the appropriate or minimum numbers contained in this
document are considered minimal and the Executive Director shall have the authority to
make adjustments when it is determined that the standards would cause the numbers or
locations to be insufficient to adequately meet the needs of people with disabilities
based on the nature, use, and other circumstances of any particular building or facility.
In determining the appropriate number and location of a particular element, space, or
fixture, the following factors shall be among those considered:
(i) population to be served
(ii) availability to the user;
(iii) location relative to distance and time;
(iv) location relative to isolation and separation;

(v) function of the building or facility; and
(vi) equal treatment and opportunity
EXCEPTION: Commercial Facilities and Public Accommodations Located in Private
Residences. When a commercial facility or public accommodation is located in a private
residence, the portion of the residence used exclusively as a residence is not covered
by these standards.
Those portions used in the operation of the commercial facility or public accommodation
or that portion used both for the commercial facility or public accommodation and for
residential purposes is covered by the new construction and alterations requirements of
these standards.
The portion of the residence used in the operation of the commercial facility or public
accommodation extends to those elements used to enter the commercial facility or
public accommodation, including the homeowner's front sidewalk, if any, the door or
entryway, and hallways; and those portions of the residence, interior or exterior,
available to or used by employees or visitors of the commercial facility or public
accommodation, including restrooms.

406.6 Diagonal Curb Ramps.
Diagonal or corner type curb ramps with returned curbs or other well-defined edges
shall have the edges parallel to the direction of pedestrian flow. The bottom of diagonal
curb ramps shall have a clear space 48 inches (1220 mm) minimum outside active
traffic lanes of the roadway. Diagonal curb ramps provided at marked crossings shall
provide the 48 inches (1220 mm) minimum clear space within the markings. Diagonal
curb ramps with flared sides shall have a segment of curb 24 inches (610 mm) long
minimum located on each side of the curb ramp and within the marked crossing.

68.102. Public Right-of-Ways Projects. (New section effective February 1, 2005, 30 TexReg

(a) For purposes of§68.80,the estimated cost of construction for the project shall be based on
the pedestrian elements only. Construction documents submitted for review are only required to
include pedestrian elements being constructed,renovated, modified, or altered as part of the
project scope.
(b)Application of TAS shall be limited to those pedestrian elements being constructed,
renovated, modified, or altered as part of the project scope. The pedestrian elements shall comply
with applicable sections of TAS except as modified by this section.
(1) Sidewalks--At sidewalks constructed within the public right-of-way, handrails are not
required; however, if provided they must comply with TAS 405.8. Where the adjacent roadway
has running slopes of 5%or greater,the pedestrian access route shall not exceed the grade
established for the adjacent roadway. EXCEPTION: The running slope of a pedestrian access
route is permitted to be steeper than the grade of the adjacent roadway provided that the
pedestrian access route complies with TAS 405.
(2) Curb Ramps--At curb ramps constructed within the.,,,hr,. rig' + of handrails are not
required; however, if provided they must comply with TAS 405.8. For purposes of this section,
non-signalized driveways are not considered to be hazardous vehicular areas.
(A) At perpendicular curb ramps constructed within the public right of way, detectable warnings
complying with TAS 705 at a minimum of 24" in depth(in the direction of pedestrian travel)and
extending the full width of the curb ramp shall be provided where the pedestrian access
route enters a crosswalk or other hazardous vehicular area.
(B) At parallel curb ramps constructed within the public right-of-way, detectable warnings
complying with TAS 705 at a minimum of 24"in depth(in the direction of pedestrian travel) and
extending the full width of the landing shall be provided where the pedestrian access route
enters a crosswalk or other hazardous vehicular area.
(C) At diagonal curb ramps constructed within the public right-of-way, detectable warnings
complying with TAS 705 at a minimum of 24" in depth(in the direction of pedestrian travel)and
extending the full width of the curb ramp or landing, shall be provided where the pedestrian
access route enters a crosswalk or other hazardous vehicular area. Additionally,the department
will allow the detectable warning to be curved with the radius of the corner. The detectable
warning shall be located so that the edge nearest the curb line is 6"minimum and 10"maximum
from the curb line.

Curb Ramps—Surface Texture/Contrast
Administrative Rule 68.102(b)(2) and TAS 4.7.4
The ONLY surface texture TDLR is currently aware of that meets the intent of both the Texas
Accessibility Standards and the currently enforceable federal Americans with Disabilities Act
Accessibility Guidelines are detectable warnings (aka truncated domes) meeting the technical
specifications of TAS 4.29.2.
With the intention of harmonizing both state and federal requirements, the Department issues the
following technical clarifications regarding surface texture requirements for curb ramps.
Curb Ramps in the Public Right-of-Way
All curb ramps constructed, renovated, modified, or altered within the public right-of-way must
comply with Architectural Barriers Administrative Rule 68.102(b)(2).
Curb Ramps NOT in the Public Right-of-Way
All curb ramps that are constructed, renovated, modified, or altered, but are NOT within the
public right-of-way must comply with TAS 4.7.
The surface texture and contrast must extend the full width and depth of the curb ramp based on
TAS 4.7.4. Parallel curb ramps shall be allowed to have the surface texture and contrast on the
two ramped surfaces unless the landing connects to a public street or public right-of-way.
The Department strongly encourages the use of detectable warnings complying with TAS 4.29.2
as the surface texture and contrast in lieu of the surface textures listed under TAS 4.7.4(1).
as a means to satisfy both the state and federal requirements.
This technical memorandum supersedes TM 99-15 issued in July 1999 which is no longer
effective. TM 99-02 remains in effect for curb ramps that are NOT in the public right-of-
way.
