THAT, MLRP Park West Crossing LLC, known herein as GRANTOR, in consideration
of the sum of Ten and No/100 Dollars ($10.00) and other good and valuable consideration paid by
the City of Coppell, Texas, a municipal corporation of Dallas County, Texas, hereinafter "City",
receipt of which is hereby acknowledged, does hereby grant, bargain, and convey to City
(GRANTEE), it successors and assigns, a permanent right of way and the right to construct,
reconstruct and perpetually maintain a public street and/or drainage facilities and utilities, together
with all necessary appurtenances thereto, and with the right and privilege at any and all times, to
enter said permanent right-of-way, or any part thereof, as is necessary to the proper use of any other
right granted herein, and for the purpose of constructing, reconstructing and maintaining said public
street and/or drainage facilities and utilities, and for making connections therewith, in, upon and
across said permanent right-of-way.
Said right-of-way being described in Exhibits "A" and "B" attached hereto and made a part
hereof for all purposes.
That in consideration of the benefits above set out, Grantee will remove from the easement
strip, such fences, buildings and other obstructions as may be found upon said property. After
construction has been completed or after any entry for repairs or maintenance, GRANTEE shall,
except for removed obstructions,return the surface area to its original conditions subject to the rights
granted herein. GRANTOR shall not be obligated for future maintenance and upkeep of the right of
way area, and GRANTEE shall be solely responsible for the maintenance and upkeep of the right-
of-way area, subject to any duties imposed by the ordinances of the City of Coppell or otherwise
imposed by law.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns for
the purposes aforesaid, the right-of-way above described, subject to the matters herein stated and
without express or implied warranty. This right-of-way and the rights herein granted are made
subject to all matters of record or otherwise affecting title to or use of the right-of-way area. All
warranties that might arise by common law or statute are excluded, and this right-of-way is made
without any warranty whatsoever.

RIGHT-OF-WAY DEDICATION
BEING a tract of land situated in the JAMES A. SIMMONS SURVEY, ABSTRACT NO. 1296,
City of Coppell, Dallas County, Texas and being part of Lot 1, Block A of PARK WEST
CROSSING, an Addition to the City of Coppell, Dallas County, Texas according to the Plat
thereof recorded in Document No. 201400079953, Map Records, Dallas County, Texas and
being more particularly described as follows:
BEGINNING at a 1/2 inch iron rod with a yellow plastic cap stamped "HALFF" found at the
intersection of the east line of Freeport Parkway, a 95 foot right-of-way, with the south line of
Southwestern Boulevard, a 60 foot right-of-way, for the northwest corner of said Lot 1;
THENCE North 85 degrees 29 minutes 25 seconds East, with said south line, a distance of
26.08 feet to a 1/2 inch iron rod with a yellow plastic cap stamped "JVC" set for corner;
THENCE South 43 degrees 50 minutes 52 seconds West, leaving said south line, a distance of
29.89 feet to a 1/2 inch iron rod with a yellow plastic cap stamped "JVC" set for corner at the
beginning of a non-tangent curve to the left having a central angle of 01 degrees 32 minutes 57
seconds, a radius of 785.00 feet and a chord bearing and distance of South 00 degrees 41 minutes
58 seconds West, 21.22 feet;
THENCE Southerly, with said curve to the left, an arc distance of 21.22 feet to a 1/2 inch iron
rod with a yellow plastic cap stamped "JVC" set for corner;
THENCE South 00 degrees 04 minutes 28 seconds East, a distance of 41.65 feet to a 1/2 inch
iron rod with a yellow plastic cap stamped "JVC" set for corner;
THENCE South 89 degrees 55 minutes 32 seconds West, a distance of 9.97 feet to a 1/2 inch
iron rod with a yellow plastic cap stamped "JVC" set for corner in the east line of the above
mentioned Freeport Parkway, said point being at the beginning of a non-tangent curve to the
right having a central angle of 05 degrees 57 minutes 05 seconds, a radius of 795.00 feet and a
chord bearing and distance of North 03 degrees 23 minutes 31 seconds East, 82.54 feet;
THENCE Northerly, with said east line and said curve to the right, an arc distance of 82.58 feet
to the POINT OF BEGINNING and containing 890 square feet or 0.020 acres of land, more or
less.
