§ KNOW ALL MEN BY THESE PRESENTS
COUNTY OF DALLAS §
THAT, Frisco 5 Ventures, LP, a Texas limited partnership, known herein as
GRANTOR, in consideration of the sum of Ten and No/100 Dollars ($10.00) and other good
and valuable consideration paid by the City of Coppell, Texas, a municipal corporation of
Dallas County, Texas, receipt of which is hereby acknowledged, does hereby grant, bargain, and
convey to said City of Coppell, Texas (GRANTEE), it successors and assigns, a permanent
right-of-way and the right to construct, reconstruct and perpetually maintain a public street
and/or drainage facilities and utilities, together with all necessary appurtenances thereto, and
with the right and privilege at any and all times, to enter said permanent right-of-way, or any
part thereof, as is necessary to the proper use of any other right granted herein, and for the
purpose of constructing, reconstructing and maintaining said public street and/or drainage
facilities and utilities, and for making connections therewith, in, upon and across said permanent
right-of-way.
Said right-of-way being described in Exhibit "A" attached hereto and made a part hereof
for all purposes.
That in consideration of the benefits above set out, Grantee will remove from the right-
of-way, such fences, buildings and other obstructions as may be found upon said property. After
construction has been completed or after any entry for repairs or maintenance, GRANTEE shall,
except for removed obstructions, return the surface area of the easement strip to its original
condition as nearly as practical taking into consideration the nature of the work being performed.
GRANTOR reserve the right to use and maintain the surface of the easement strip for purposes
which will not interfere with GRANTEE'S rights hereby granted and agree that, GRANTEE
shall not be obligated for future maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns
for the purposes aforesaid, the premises above described.

Legal Description of Right-of-Way
BEING a tract of land situated in the Cordelia Bowen Survey, Abstract No. 56, also being
situated in Lot 1, Block C, Duke Lesley Addition Dividend Drive & Point West Boulevard, an
addition to the City of Coppell, Dallas County, Texas, according to the plat thereof recorded in
Instrument No. 20070240528, Official Public Records, Dallas County, Texas, and being out of
and a portion of that certain tract of land conveyed to Frisco 5 Ventures, LP, by Special
Warranty Deed dated July 30, 2007, and recorded Instrument No. 20070290188, Official Public
Records, Dallas County, Texas, and being more particularly described by metes and bounds as
follows:
BEGINNING at a 1/2" iron rod found with cap for the southeast corner of said Lot 1, Block C,
same being at the intersection of the north right-of-way line of Interstate Highway No. 635 with
the east right-of-way line of Beltline Road (120' right-of-way);
THENCE along the north right-of-way line of Interstate Highway No. 635, same being the south
line of said Lot 1, Block C, North 71 degrees 35 minutes 05 seconds West, a distance of 39.89
feet to a Point;
THENCE through the interior of said Lot 1, Block C, the following five (5) courses:
1. Along a non-tangent curve to the left having a radius of 84.00 feet, an arc distance of
45.18 feet, through a central angle of 30 degrees 49 minutes 01 seconds, and whose
chord bears North 15 degrees 27 minutes 25 seconds East, a distance of 44.64 feet to a
Point;

Block C, Duke Lesley Addition, South 89 degrees 58 minutes 18 seconds East, a distance of
2.00 feet to a chiseled "x" set in concrete found on the west right-of-way line of Beltline Road;
THENCE along the west line of Beltline Road, South 00 degrees 02 minutes 55 seconds West, a
distance of 1055.57 feet to the POINT OF BEGINNING hereof and containing 0.4655 acres or
20,279 square feet of land, more or less.
