We hereby request a partial extension of contract time on the above contract for a total of
Eighty One(81)consecutive calendar days.
This request for an extension of time is based on the following delays created by the
followings situations:
1. Densities using wrong proctor
• September 29,2015 - Densities were taken along the subgrade and
the underground utilities by HVJ Associates. The lab told us that
the densities complied with the specification requirements. Based
on that information we started to work on the subgrade preparation
and all activities related to the concrete pavement, rebars and
forms installation. Also, we scheduled concrete to be poured on
Friday October 2nd.
• October 1,2015 -The laboratory reports for the densities taken on
September 29th were submitted, and, as the technician told us, the
densities on Edgewood passed and complied with the project
specification requirements.
• October 2, 2015 — Ready to pour the concrete pavement, we
received an email from the City inspector indicating that he was
having a concern regarding the densities results, based on that he
believed that the densities were taken using a proctor not
representing the existing material on site. He gave us instructions
to cancel the concrete pour and requested the lab to perform a new
proctor test on the existing soil.
• October 5,2015—New densities were taken using the new proctor
and the results showed that the densities were out of specification

requirements. The inspector requested to remove the rebar and
forms in order to rework the subgrade along as the trench until the
densities reached specification requirements.
• October 19, 2015 - After performing all necessary work on the
subgrade, densities were taken and complied with specification
requirements. We scheduled concrete and pour the concrete
pavement that same day.
For this situation,we respectfully request Twenty(20)calendar days.
2. In addition, and concurrently the project was affected by adverse weather
conditions, which included record rain and thunderstorms in the Dallas — Fort
Worth area during the year 2015. As you can see from the documents attached,
from May 2015 through December 2015 there were 61 days with rain and/or
thunderstorm having an average of 0.5" — 3" rainfall. These adverse weather
conditions affected the soils conditions and made it almost impossible to perform
work during the rainy days and sometimes the day after, depending on the
rainfall.

For this situation, we respectfully request Sixty One(61)calendar days
Also,we must comply with applicable Federal, state and local codes and standards,
including compliance with:
I. Occupational Safety and Health Administration (OSHA) standards - Under the
Occupational Safety and Health Act of 1970, all employers must comply with OSHA
standards and must exercise reasonable diligence to determine and to ensure the safety of
their employees and the public who may be in proximity to renovation,demolition,
construction, installation,or maintenance and repair operations conducted by contractors.
II. FAR 52.236-13 --Accident Prevention (Nov 1991)
(a)The Contractor shall provide and maintain work environments and procedures which
will --
(1) Safeguard the public and Government personnel,property,materials,supplies, and
equipment exposed to Contractor operations and activities;

(b)For these purposes on contracts for construction or dismantling,demolition,or
removal of improvements,the Contractor shall --
(1)Provide appropriate safety barricades,signs, and signal lights; and
(2)Comply with the standards issued by the Secretary of Labor at 29 CFR Part 1926 and
29 CFR Part 1910;
III.Section 107 of the Contract Work Hours and Safety Standards Act
(Construction Safety Act)-This section requires as a condition of each contract for
construction, alteration, and/or repair,that no contractor or subcontractor contracting for
any part of the contract work shall require any laborer or mechanic employed in the
performance of the contract to work in surroundings or under working conditions which
are unsanitary,hazardous,or dangerous to his health or safety, as determined under
construction safety and health standards promulgated by the Secretary of Labor by
regulation.
IV. The contractor's Safety and Occupational Health (SOH)general responsibility
is to:
• Ensure the SOH of contractor's employees.
•Ensure compliance with all applicable Federal, state and local codes and standards,
including SOH standards,as well as any additional specific requirements invoked by
contract. Contractors are responsible directly to OSHA or appropriate state office where
OSHA has approved a state plan.
•Protect the public within the contract work area and protect government property.
The Contractual Completion Date was January 16,2016. This extension of Eighty One
(81)days makes April 6, 2016 the Contractual Completion Date
