Morrison Hydrology Engineering, Inc. 210 Arnold Arlington, TX 76010 Flood Study on 10/48 Acre Tract on Sandy Lake Road #FS99-03 (Town Homes of Coppell) Dear Mr. Morrison: Recently I was provided a letter conceming a wetland investigation on a 10-acre tract of land referred to as the Town Homes of Coppell. The determination from the U.S. Army Corps of Engineers is that there are waters of the United States as classified under Section 404 on the subject property. Therefore, a permit is required for the discharge, dredging or filling of any materials in the areas identified as waters of the United States. The determination from the U.S. Army Corps of Engineers was made from a report entitled "Delineation of Weftands and Jurisdictional Waters of the U.S. relating to Section 404 of the Clean Water Act" dated May 18, 1999, revised May 30, 2000, and prepared by Morrison Hydrology Engineering. The City of Coppell does not have a copy of the study referenced by the U.S. Army Corps of Engineers determination. Please provide a copy of that study to this office. On August 24, 2000 you provided three copies of a flood study for a conditional letter of map revision for the Town Homes of Coppell. You also at the same time provided two copies of CDC information. At the time that the studies were delivered to my office, you provided a letter statIng that Mr. Steve Topletz was the developer and you were alerting him that he needed to provided checks for both FEMA and City review. Needless to say the floodplain study surrounding the 10/48 acre tract of land has been very confusing, but my records show that on June 7, 1999 FEMA issued a Conditional Letter of Map Revision based on a study entitled "Flood Study in Support of a Conditional Letter of Map Revision for the Elm Fork of the Trinity River for a 10/48 acre tract south of Sandy Lake Road and west of MacArthur Blvd., City of Coppell, Texas" dated April 26, 1999 prepared by Morrison Hydrology Engineering. Based on that June 7, 1999 letter, obviously we have allowed work to take place on the 10-acre tract of land. However, at this time I need clarification on the following issues: 1. Please provide a Copy of the Wetlands Study provided to the U.S. Corps of Engineers of which they made their wetlands determination; 2. Clarification on whether or not the Jane 7, 1999 CLOMR is still correct for the 10 acre tract of land and whether the 10 acre tract of land is being developed and filled in accordance with that CLOMR; 255 pARKWAy t p O BOX 478 ~ COppELL TX 75019 t TEL g72/462 0022 ~ FAX 972/304 3673 Clarification on why a request for a CLOMR was submitted in August 2000 for the same 10- acre tract of land. If there are differences between the 1999 CLOMR and the requested 2000 CLOMR, those differences need to be pointed om in narrative form and a check needs to be immediately provided to the City for the review of the revised Request for CLOMR or'else those reports will be provided to you and removed from our office.
