Dear Mr. Doyle:
This letter is provided concerning our original letter dated August 8, 1989, which requested your review
of a drainage easement amendment for a drainageway within the Creek View Addition. Following our
submittal of the referenced letter to your office, I had a telephone conversation with Mr. Gabe Favre from
Ginn, Inc., concerning this Issue. We discussed the quantity of flow in the drainageway and our HEC-2
model, which shows resulting flow depths in this area. Mr. Favre said he had some items to review
concerning this request and would call me if he had any further questions.
On October 10, we received a copy of a letter from Mr. Favre which was dated August 14, 1989. It is
particularly distressing that it took nearly two months for a copy of this letter to be provided to our office.
We also have several concems over the content of that letter. The following outlines our concerns and
comments.
Mr. Favre suggests that the drainage easement in question was previously identified as a
*'green space" and was to be utilized for various utilities. A review of the final plat clearly indi-
cates that this area was identified only as a "drainage easement." As such, it is reserved to
insure proper conveyance of storm runoff and has no other restrictions. All of the utilities within
the Creek View Addition are already in place and are located along the streets. There are no
utilities in the easement in question, nor is it identified as a utility easement.
In a telephone conversation with Richard Diano, it was confirmed that there is no commitment or
dedication of this area ss an "open space" area. In fact, this area is physically within the back
yards of adjacent properties. The requested drainage easement adjustment will provide only for
additional area for usable back yards to these properties. The area will still remain open and
may be raised to become usable open space within these private back yards. The designation
of this area as a drainage easement does not preclude any property owner from clearing the
· trees from this area. Clearly, the act of removing these trees would not reduce the ability of the
drainage easement to convey runoff and was actually suggested by a member of the City
inspections staff. It is neither the intent nor desire of the developers to perform any unneces-
sary clearing, but rather to reduce the easement by 15 feet so as to provide useable yard areas
for the properties Impacted by the easement.
Mr. Favre states that "We did not receive Information regarding the validity of Mr. Wallace's
statements pertaining to the flooding." We would have been more than happy to provide Mr.
Favre with any data he required to perform his review. In my conversation with Mr. Favre, I dis-
cussed the approach we used to analyze the sItuation and Informed him that we could provide
him with whatever information he required. The fact is that Mr. Fawe did not request any data
from us for review, nor did he inform us that he intended to recommend denial of this request. I
am enclosing copies of data used in our analysis and the HEC-2 model which is based on a
cross section of 3 feet bottom width with 3:1 sideslopes.

Due to construction schedules, i~ Is Imperative that we move forward with thIs easement amendment
promptly. Please let me know what formal procedures and documents we need to submit to abandon
the previous easement and adopt the proposed "drainage easement."
