Several variances are being requested for this subdivision; they are as

VARIANCE il: Waiver of requirement of a full flow meter.
STAFF CO~fl~ENTS: The Public Works Department will be present at the
meeting to discuss this issue.
VARIANCE ~2: Assessment for water and sewer fees be 1/mired to
office area.
STAFF COF~NTS: The Subdivision Ordinance requires that the fees for
the water and sewer availability be calculated by
the square footage of the entire building.
VARIANCE f3: Request that requirement for landscaping be
datarmined at the tim~ of Building Per. it.
STAFF COHHEKTS: Staff has no obJecticn to this request.
VARIANCE ~4: Request Water and Sewer Availability Fee be assassed
(1001) at the time of Building Permit.
STAFF CO~fENTS: No Couaaent. Subdivision Ordinance requires 50~ due

Subject: Hager Containers Addition
We have reviewed the preliminary/final plat and construction
plans for the above referenced project.
Per the sub-division ordinance and master thoroughfare plan,
Royal Lane is classified as a major thoroughfare and thus
requires a 110' right-of-way. A 100' right-of-way currently
exists. As a result, the staff has requested an additional 5' of
right-of-way to be dedicated along the frontage. This request
will be made to all properties fronting Royal Lane as each
property goes through the platting process.
For your information, the reason the City requires 110' of right-
of-way vs. 100' is to allow adequate width in the parkways for
City utilities, other public utilities, sidewalks and landscape
and irrigation. Experience has shown that this additional 5'
greatly reduces the chance or need to "stack" utilities, etc. due
to parkway width restrictions.
The other comment we have is in regards to the construction plans.
The fire lane is required per the sub-division ordinance to be 6"
of concrete (3000 psi) on a 6" lime stabilized subgrade. The
staff does not support crushed stone as an acceptable alternative
to this requirement.

Variance 1 - Should adhere to Standard Construction
Details/Subdivision Ordinance. It is staff's opinion, if possible,
that all fire and domestic services be combined into one combination
line which would appear to be cost effective for the developer
and at the same time adhere to the Standard Construction Details.
The remaining variances, staff feels will be at Council's descretion.

At~ached is a copy of the two packe~s for the preliminary and final
plats of the Hager Container Addition.
Please respond by September 1, 1988 to Taryon Bowman providing your
individual recommendations regarding the requested Variance t2 and
Variance t4, regarding water and sewer availability fees and the 'waiver
thereof, etc.
Should staff recounend one way or the other, the change in calculating
fees (variance 12), reducing the yield of the fee regarding any finan-
cial ramification (e.go water and sewer rates determination and their
dependency on fees collected, etc.), as well as any lesal ra~lfication
since, as I understand, we are being challensed in the courts resardinE
fees of the past.
If you have any questions, please do not hesitate calling either Taryon
or myself. Thank you.

Attached is the recommenda~ion Ginn, lac. gave on subject plat.. Kevin
did a very good Job, and ha and I discussed ~he ~atter at great length.
l~hile he may have provided appropriate responses, ! am concerned for the
integrity of the future and maintenance of the City's Transportation and
Street Plans (Subdivision Ordinance, etc.).
Specifically, if we have only ten (10) feat of Parkway and five (}) foot
easement, will that confine us to a condi~ion that is undesirable~
That is, when there are inlets and/or fire hydrants, et al in ~he
parkway, will the pavemen~ be protected from cutting by having enough
R.O.W. for the utilities (theirs and ours)? Or will we sometime in the
future on these narrower R.O.~.~s, have to let utili~ies occupy either
the medians or ~he corridor under our pavements? Also note when Cities
build right turn lanes, sometimes additional R.O.~. is needed at a
higher cost than when pla~ting, att.
If your consideration would produce anything o~her than what has trans-
pired to-date, then written co.ants should be forwarded to Taryon
Bowman on or before September 1, 1988, so that it ~ill be timely for
advise to the City Council on the Hager Plats. Thank you.

Dear City Council:
On the request of HaEer Containers, Inc., we are in the process of pre-
patenE a plat of a 4.673 acre tract that is located approximately lO0O
ft. east of $.H. 121 and 1000 ft. south of Thweatl Road (Sandy Lake Road)
alonE the east side of Royal Lane. ~r. Ted fiaEer has stated tha~ he does
not plan to develop the ~ract immediately; but, he does plan to develop
within the next 2 to 6 years.
Due to the construction timini, to occur at a later date than the filinE
of the final pla~, we are requestinE, on behalf of ~r. HaEer and Mr. ~ark
Connell, that the followinE variances to the subdivision ordinance be al-
lowed in conjunction with the approval of said plat.
1. Request that a full flow water meter not be required
on the water line that is to be used exclusively for
fire service requirements.
2. Request that ~he assessment for water and sewer fees
be limited to the office area of ~he buildinE for
calculatinE associated fees.
$. Request that the requirements for landscapinE, which
affect this tract, both conceptual and detaiied, be
determined upon submittal of a Buildini Permit Request.
4. Request that the water and sewer availability fee be
assessed (lOO%) at the time of a BuildinE Permit Request.
For fee calculations, we request that ~he area of "vari-
ance request No. 2" be used to determine the associated
cost,
