It has been some time since Highland Oaks Addition went before
Council and the issue of the completion of the Hiqhland Meadow
C~rc]~ was discussed. You may recall the leng{hy discussion
amongst the parties involved about the road com~nq out of Hiqh-
land Meadow At first, we had it aligned with Lodge Road a-
C~6ss Sandy Lake. At the time, we tried to get the Highland
Oaks owners to dedicate the small triangular piece from the
northeast corner of their tract so the center lines could be
aligned properly. They refused to cooperate with us, so we re-
quested permission to shift the alignments so the entire right-
of-way would fall on our property. In the City Council meeting,
you may recall, you recommended the alignments be centered prop-
erly, that Univest construct the road concrete up to the proper-
ty line, and that the City would require the needed additional
dedication and pavement completion from the adjacent property
owner at the time of his plat review. On this agreement, the
subdivision was approved, developed and accepted by the City.
We now see that the Highland Oaks subdivision is completed with
brick entry features and all and we are now being asked by the
City when we are going to complete the pavement. Given the dis-
cussions and events which we had at the time that Highland Mead-
ows was developed, this pavement is not our responsibility. In
fact, we do not own the land involved.
We would appreciate your clarification of our agreements and
responsibilities with the City since we are being questioned on
this issue.
