the United States of America to the payment of which sum, well and truly to be made, to the Principal and

THIS CONDITION OF THIS OBLIGATION IS SUCH THAT, WHEREAS the Principal entered into a
contract with the Obligee for:
Site utilities for Jefferson at Riverchase Apartments, 600 S. MacArthur Blvd., Coppell, Texas
AND WHEREAS, the Obligee requires a guarantee from the Principal against defective materials and
workmanship in connection with said contract.
NOW, THEREFORE,If the Principal shall make any repairs or replacements which may become
necessary during the period of two years because of defective materials or workmanship in connection
with said contract of which defectiveness and the Obligee shall give the Principal and Surety written
notice within (30) thirty days after discovery therof, then this obligation shall be void; otherwise it shall be
in full force and effect.
All suits at law or proceedings in equity or recovery on this bond must be instituted within (12) twelve
months after the expiration of the maintenance period provided for herein.

for the period of Two year(s) after approval of the final estimate on said job, by the owner,
against all defects in workmanship and materials which may become apparent during said period, and
WHEREAS, the said contract has been completed, and was approved on September 23, 1996
NOW, THEREFORE, THE CONDITION OF THIS OBLIGATION IS SUCH, that if within two
year(s) from the date of approval of the said contract, the work done under the terms of said contract shall
disclose poor workmanship in the execution of said work, and the carrying out of the terms of said
contract, or it shall appear that defective materials were furnished thereunder, then this obligation shall
remain in full force and virtue, otherwise this instrument shall be void.
PROVIDED HOWEVER, this Maintenance Bond is only furnished in accordance with the
maintenance provision of the underlying contract.
