Subject: Paragon Cable/Access Area from Village Pky to Deforest on MacArthur.

At the Council meeting of 23 February several Council members mentioned to Paragon's
Representative Sherry Gardener that the mounds of dirt (along MacArthur) left from the
installation of Fiber Optics should be removed. Sherry responded that this would be done.
The following week the mounds of dirt were displaced along the access area from (north of
Parkway) Village Pky to Deforest. It was not leveled mulched or planted.
Mid March I attempted to talk to Sherry Gardener (972-501-7000) regarding Paragon's
responsibility in returning the access area back to some semblance of normality. She was
unavailable and I ended up having a discussion with their Upgrade Supervisor Mark Liggett
(972-245-7662) who indicated that he felt Paragon had fulfilled their obligation and that they had
seeded the area. He would check to make sure but felt they were done with their responsibilities.
No changes were forthcoming, so on 12 April I spoke with Sherry Gardener who assured me that
the matter was taken care of. She intimated that perhaps it just was not to "MY"
expectations ...... Responded that I didn't that I didn't think it met the expectations of Coppell.
On the 23rd of April the Citizen Advocate printed a picture on page 3 showing what Paragon had
left us and how it should have been.
I talked again on 5 May with Paragon's Upgrade Supervisor Mark Leggett (Sherry Gardener is
no longer with Paragon) who indicated that they intend to re-seed some of the area in the next
couple of weeks and he feels that is all that is needed.
I have a some questions:
What are the standards (guidelines) that a contractor must adhere to when tearing up acces~
areas?
Is there someone who monitors contractors to ensure they return thc access areas back to thc
original configuration?
Does the city have any recourse to ensure access areas are returned to an acceptable condition?
I do not think just throwing some seed down will put this area back the way it was.

Ken, I was one of the participants in Leadership Coppell '99 and I was very impressed with your
detailed presentation. I am hoping you can lend some support in rectifying this situation or point
me in the fight direction. -
