Dear Ms. Boyd:
Thank you for your letter of August 5, 1997 requestin8 permission for the Lakes of
Coppell Homeowner's Association (ltOA) to assume the landscape maintenance of the
MacArthur Boulevard Medians. As you may recall there was considerable debate between
the (I{OA) and the City of Coppell several years aSo when the HOA demanded the City
assume all maintenance responsibilities for these medians. In short, the City does not want
to transfer the maintenance respons~ility unless the transfer remains final.
The City will permit the HOA to assume the maintenance effective November 15, 1997. It
is understood the HOA will be totally and exclusively responsible for the routine
maintenance of the medians to include: water, turf grass management, tree maintenance,
landscape plant maintenance (shrubbery, bedding plants, etc.), and pesticide management
at the HOA's expense. AH maintenance must be in compliance with the City's contractual
mowing standards (See Attached). Maintenance may exceed the standards, subject to
approval by the Park Operations Superintendent, Dennis $1ayton, who may be reached by
telephone at 304-3554.
The City will continue to provide water for irrigation use, however, the irrigation of the
medians MUST comply with the City's water rationing schedule. During periods of
extended drought and/or excessive demands on the City's water resources, the water for
the medians will be subject to cut offlike other median irrigation systems within the City.

If you find the above terms acceptable please execute the sigrmture block provided below
and return a copy of this letter to my office by November 1, 1997. Please also include a
copy of the minutes of the board meetinff of the HOA and/or resolution of the Board of
Directors approvinff this agreement.
