Dear Tom:
On this date, Mr. Tom Dixon and I conducted a complete inspection of
all roadways under Part A of your contract regarding the above referenced
project. The items listed below are the findings of our inspection. These
items must be satisfactorily completed prior to Nathan D. Maier Cunsulting
Engineers, Inc., as engineer of record, requesting a final inspection and
acceptance from the City of Coppell.
MACARTHUR BOULEVARD - NORTHBOUND LANES
1. Complete general clean-up from Sandy Lake Road north to Village Parkway
South.
2. Install barrier free ramps with brick pavers at all required locations
(although barrier-free ramps have been made a part of Part B of the
Contract for payment purposes, as you know, Mr. Randy Fleming of Ginn,
Inc. has stated as late as this week that said ramps with brick pavers
must be completed before the City of Coppell will accept the roadways
under Part A of the contract).
3. Complete repair and reinstallation of the fire hydrant opposite the
Parkway Boulevard intersection.
4. General clean-up around barrier-free ramps.
5. Sweep off all pavement.
MACARTHUR BOULEVARD - SOUTHBOUND LANES
1. General clean-up at DeForest Road intersection, including backfill
behind curb.
2. 'General backfill behind all curbs.
3. Remove earthen berm near tree line at Samuel Boulevard intersection.

3. Remove metal guard rail frown site.
WARREN DRIVE
1. General backfill behind all curbs and inlets.
2. Sweep off all pavement.
VILLAGE PARKWAY
1. General backfill behind all curbs.
2. Install barrier-free ramps with brick pavers at all required
locations.
3. Sweep off all pavement.

SANITARY SEWER
1. Clean out dirt or other debris from all manholes and all lines by
whatever means necessary to secure timely acceptance of said lines and
manholes by the .City of Coppell. As you know, you assured me in your
office last Thursday, October 2, 1985, that if I issued a Notice to
Proceed for Part B of the Contract dated October 7, 1985, you would do
whatever was necessary to satisfactorily clean all sanitary sewer mains
and manholes, even if it meant bringing in a jet cleaning vehicle.
According to representatives of the City of Coppell, final acceptance
of the utility contract (Mario Sinacola and Sons, Inc.) cannot occur until
final acceptance of the roadways under Part A of you contract has occurred.
Time is and has been a critical issue to the Owner, as your are aware, since
the inception of your contract. Therefore, I must inform you that if all
items listed above are not completed by close of business on Monday, October
14, 1985, or if a concentrated effort, in our opinion, on the part of Jensen
Construction Company to complete these items in the most expedicious manner
possible is not made, all work under Part B of your contract will be
suspended in accordance with Item 1.44 of the Standard Specifications For
Public Works Construction as published by the North Central Texas Council of
Governments. No time extension for Part B will be granted should work on
Part B be suspended and liquidated damages in the amount of $750.00 will be
assessed by the Owner for each day of delay beyond November 20, 1985 that
all items contracted for are not completed.
