We are writing regarding the fence which is the subject of the above referenced case. As
you are aware, Summary Judgment was granted in favor of the City of Coppell in the above
referenced matter by an Order signed by Judge Godby on October 1, 1998. The Order granting i-
Summary Judgment ordered Mitchell Reitman to desist and refrain from maintaining the fence ,
on the property of the City of Coppell, as well as ordering Mr, Reitman to remove the fence he
had constructed in I997 and all of its appurtenances. Ihe order granting Summary Judgment
also gave the City of Coppell the right to enter the property of Mr. Reitman and remove the fence
and all of its appurtenances. Although Mr. Reitman appealed portions of the order granting
Summary Judgment, Mr. Reitman did not appeal the counter-claim made by the City of Coppell.
Furthermore, neither the trial court nor the Clerk's office shows any record of a Supersedeas
bond or deposit in this case. Therefore, the order granting the counter-claim of the City of
Coppell is a final judgment. Therefore, the final judgment requires Mr. Reitman to remove the
portions of his fence that extends past his property line.
We are writing to notify Mr. Reitman that he has ten (10) days from the date of this letter
to remove all portions of his fence that extends beyond his property line. We have attached a
copy of the relevant portions of the plat of Mr. Reitman's property to indicate the property lines.
If Mr. Reitman does not remove the portions of his fence that extend beyond his property line
within ten (10) days of this letter, the City will have the portions removed.
