Lake Park-CS 910917 COPPELL PUBLIC WORKS . -" DATE: September 17, 1991 TO: Larry Davis, Construction Inspector FROM: Rick Wieland, Parks and Recreation Manager RE: Lake Park Addition - Park Site Issues This memorandum is in response to our conversation of last week regarding the final walk through conducted on the Lake Park Addition and subsequent park development. Before addressing concerns about the park site, I would bring to your attention that I am attaching a copy of the following information: - Enlargement of typical cross-section study of the lake. - Highlighted park land donation agreement - extension of time for park site. - Copy of the November 24, 1987 Park Land Donation Agreement. Particular attention may be given to conditions # 3, 4, 5, 8 & 9 found within the agreement. This should help address questions that have been posed concerning completion times, acceptance dates cover and so on. In regard to concerns found during the final walk through of the subdivision, the following areas were found to be in question: - The grass slope found on site does not appear to conform to the four to one (4:1) ratio required. - The 10' wide jogging/pedestrian path needs to be located on site by the City and graded as indicated on typical cross section. - Along the edge of the property which runs parallel to the Phillips Lane and Meadowwood Lane alleyways, wooden or steel poles centered no more than five feet (5) apart without cable should be installed to restrict and vehicular traffic to this portion of the property. - The turf should have 85% of area established within the park site. Pro rata charges shall not be due and payable until after the time UPI records a final plat of the land owned by UPI adjacent to the UPI ~ight-¢f-V~'ay and UPI obtains a building permit to construct improvements on the land owned by to the west of the UPI Right-of-Way. The Agreed Pro Rata charges shall only be far standard sizing and include only the pro rata portion of the actual construction costs thereof. IV. Park Land Donation Agreement-Extension of Time. As used herein, "Park Land Donation Agreement" means that certain Park Land Donation Agreement, dated November 24, 1987, between Coppell Town Center, Inc. ("CTC") and City pertaining to the construction of a lake upon certain land described therein and subsequent donation of such land to City. City and UPI agree that the date of October 1, 1988, referenced in Paragraph 8 of said Park Land Donation Agreement shall be amended to extend such date to a date one (1) year after the completion date of the MacArthur Extension and Bridge and the date of December 31, 1989, referenced in said paragraph shall be amended to extend such date to a date two (2) years after the completion date of the MacArthur Extension and Bridge. The provisions of this paragraph are an amendment to the Park Land Donation Agreement. V. Lake Park Addition Preliminary Plat. City has issued approval of a preliminary plat filed with City by UPI for the Lake Park Addition (the "Lake Park Addition Preliminary Plat"). City hereby agrees to extend the City's approval of the Lake Park Additional Preliminary Plat until that date which is one (1) year after the MacArthur Extension and Bridge Completion Dates. VI. Attorneys' Fees.
