June 14, 1996 Natgun Corporation 11 Teal RoaStt Wakefield, s 01880 Re: City of Coppell Village Parkway Ground Storage Reservior No. 2 Gentlemen: Although the Village Parkway Ground Storage Reservior has been in service since June 6, 1996, several items of work on the tank remain incomplete. Most critical at this time is the access ladder and level controls on the tank. Leaving the tank in its current state of completion is creating an unnecessary hardship and burden on the City of Coppell. We understand that the circumstances surrounding the finish coat color on the tank has caused delays on the project; however, in your fax transmittal dated June 7, 1996, it was indicated that the access ladder and level controls would be installed prior to application of the finish coat. As of the date of this letter, neither of these items have been completed. We are in receipt of your letter dated May 22, 1996, requesting a contract extension to the end of June. At this point, the City is not inclined to grant a formal contract time extension. Contract time on this project expired on May 18, 1996. The city can elect to assess liquidated damages in the amount of $500 per day for every day the project remains incomplete beyond the established contract time. It is our understanding Natgun intends to have a new project superintendent on site the week of June 17, 1996. In the mean time, please immediately provide the necessary equipment, personnel and materials required to complete the access ladder and level controls on the tank. cc: M/r. Kenneth M. Griffin, P.E.
