Attached please find a copy of a letter I received from Ron
Morrison, P.E. of K~ley-Horn & Associates, Inc. dated
Septe~er 13, 1990, per his review of your recitation project.
As a result of our meeting with you on Septe~er 13, 1990 and the
referenced letter, we provide the following co~ents~
- As per the Flood Ordinance #219, Sec. 4.3-1 It~ 92, ...all
necessa~ pe~its must be obtained from federal, state or
local agencies from which prior approval is required..., such
as 404 Pe~it from Corps of Engineers (C.O.E.).
- As indicated in ~. Morrison's letter, and per dete~ination
made by C.O.E., you must obtain a pe~it under section 404 of
the Clean Water Act. The letter you provided from C.O.E. is
only a wetland dete~ination and not a 404 Pe~it. Ail
co~ents made by Ron Morrison, as per attached letter, must be
addressed within thirty (30) days from the date of this
letter.
- There shall be no reduction of, and no fill in the wetlands in
the United States without a C.O.E.'s 404 Pe~it. It is our
understanding that there is no fill work to be done in the
designated wetland areas.
- Provide grading plans with at least four (4) cross sections
including the proposed excavation and proposed fill. A
blueprint of such grading plan must also be sent to C.O.E. for
their review. Please identify and delineate the wetland areas
within your proposed subdivision.

- We received the revised final construction plan for this
project on September 13, 1990 from Dan M. Dowdey & Associates,
Inc. We will review these plans and provide you with our
comments, as it may impact the amount of proposed fill to be
placed in this subdivision, to insure no flooding in streets
and generally, in the subdivision.
- Lake Park Addition has been reviewed based on the old
Floodplain Ordinance %219, dated June 24, 1980, as per the
developers' previous agreements with the City of Coppell.
This project does not meet the criteria set forth in the
revised Floodplain Ordinance %87390 adopted back in 1987.
- The owner of the property shall furnish the City of Coppell a
letter stating that he will assume all liabilities associated
with early excavation, fill, or any construction of this
project, in and adjacent to the floodplain of Denton Creek and
will indemnify and hold harmless the City of Coppell from any
damages resulting from such development activities. This
letter must be submitted to the City prior to issuance of
early excavation and grading permit.
Upon receipt of the above indemnification letter, we
conditionally approve your request for early excavation and
ask that all the above listed comments be addressed within the
next thirty (30) days from the date of this letter.
We look forward to working with you on this project and, if you
have any questions, please let me know.

Re: Second Review of the Lake Park Addition Floodplain Reclamation Study by
Dan Dowdey and Associates
Dear Ms. Daneshmand:
On August 17, 1990, we provided our first review of the subject study. That review
identified two major items that must have been addressed before we could recommend
approval of the report. On August 24, 1990, we received a second report that addressed our
initial concerns. We have now completed our review of the second report and we have
attended a meeting with you, Mr. Tom Wise, and Mr. Bill Anderson to discuss our further
concerns. The following items will be needed before we can recommend acceptance of the
second report:
1. Corps of Engineers 404 Permit: This item is a two step process. First, a wetlands
determination must be made by the Corps of Engineers. Second, a 404 Permit
must be obtained for any fill completed in this identified area. The first step has
been completed. (See attached letter). It is our understanding that no fill work
is to be done in the lake. If so, no 404 Permit is required for this area. However,
an area within the subdivision was identified as a wetland area. No work may be
completed in this area until a 404 Permit is received from the Corps.
2. Hydraulic Model Clarifications: The following additional information is required
before we can recommend acceptance of the hydraulic model presented in the
subject report.
a. Additional cross sections are needed at the upstream and downstream
limits of the project. One cross section is not sufficient to describe the
flood elevations.

b. The effective flow definition (x3 card) should be consistent with the limits
of the floodplain.
c. The floodway model should match the recently submitted correction sent
to FEMA.
It was generally agreed at today's meeting that the finished floor elevations would be above
the 100-year ultimate condition model, and that the pad elevations would be at least 2 feet
above the 100-year ultimate condition flood elevation.
Before today's meeting we also discussed the project with John Karlsruher of Ginn Inc., and
he indicated that they have no problems with the project at this point. We also discussed the
project with Phil Deaton and Steve Yetts of Carter and Burgess and they both agreed that the
project is compatible with the MacArthur Boulevard construction that is presently underway
at the site.
Finally, the Developer may start grading work on the site, with two provisions. First, the
requirements specified in this letter should be completed as soon as possible, and second, no
structures be started until all of the provisions addressed in this letter are met.
