As you ~ow, we have been monitoring the ~ove referenced pro~sed project on
a re~lar basis. I have received Ron Morrieon's review letter dated
Sept~er 13, 1~0 (see attached), and also, I, along with Ron, met with Tom Wise
~d hie engineer, Bill ~derson, on Se~er 13, 1~0. ~. Wise is re~esting
a ~it for excavation, which ap~ars to be needed, to provide fill material
for the ~ove pro~sed subdivision.
Please note that ~. Wise is aware that he must obtain a 404 Pe~it from the
Corps of Engineers (C.O.E.), since an area on his subdivision has been identified
as wetland area. Such ~it, to my ~owledge, has not been obtained yet. ~.
Wise indicates that he will not do ~y work in the so clawed wetl~d area,
however, he would li~ to eta~ the excavation and fill in the rest of the
subdivision { ~ediately.
I would like to indicate that I have some concerns, as we are being rushed
through this process by the develo~r. The reason for my concerns is based on
our recent meeting with the Sto~ Water Manag~ent Co~ittee and engineers
involved, ~d also, input from Albe~ H. Halff. Since we have been actively
p~icipating in the Trinity River Corridor Floodplain Manag~ent, I would like
for our legal council to review the Interlocal Agre~ent, which was approved by
the City Council, to make sure we ~e in compli~ce. I would like to add that
this pro~sed s~division foll~s the rules and re~lations of our old Floodplain
Ordinance %21~ and, according to Ron Morrison, it meets the min~ FEe's
criteria. It ie ~~t to note, however, that even under the old Floodplain
Ordinance, the develo~r must comply with all state and federal agencies' rules
and re~lations. This prompts the need for a ~it to be rejected by the
develo~r for a 404 Pe~it from C.O.E.
Please note that I feel obligated to keep you info,ed of all outstanding issues,
as we continue working with ~. Tom Wise and his engineer, ~. Bill ~dereon.
I have prepared a draft letter to ~. Wise, which outlines our concerns and
co~ents, and as result of rec~endation from Ron Morrison, we are giving a
conditional approval and/or ~it for early start of excavation and grading.
This ~it is in effect for thirty (30) days to allow the developer to provide
the needed doc~ents as listed in Ron's letter.
Ae re~ested, I ~ in process of setting up a meeting with affected parties
including Jo~ Karls~her of ~i~, Inc. and ~ssibly Ron Morrison, to discuss
this project as ~r the Sto~ Water Manag~ent Report ~ittee ~rior to iseu~ce
of excavation and fill ~it.
