Curb Cut Permit
Dear Mr. Griffin:
This letter is a recap of various meetings that has taken place in reference to approving and permitting a
proposed curb cut on MacArthur Blvd. In our last meeting with Mr. Mike Martin and you, I have
summarized the details we worked out for the proposed curb cut.
National Convenience Stores Incorporated ("NCS"), a Delaware Corporation and a subsidiary of
Ultramar Diamond Shamrock ("UDS"), is in agreement to the following:
1. NCS agrees to dedicate to the City of Coppell the requested ROW of roughly 1,412 Square Feet as
shown on the attached drawing. I have attached a copy of the legal descriptions for Lot 11 for the
City to prepare the documents for the dedication. In drafting any document, NCS will be the entity
executing it.
2. NCS agrees upon the completion and the opening of the new curb cut on MacArthur Blvd. to close
one of the existing curb cuts on Sandy Lake Road as shown on the same attached drawing.
3. NCS and The City of Coppell are in agreement that due to the grade elevations that the required
pavers in the proposed curb cut cannot be installed on our property. The City of Coppell has agreed
to allow the pavers to be installed within the City of Coppell's ROW. NCS agrees to maintain, at
NCS's expense, these pavers with The City of Coppell preparing the necessary document for our
review and signature.
4. With the City of Coppell reducing the required ROW, NCS can abide by the new Sign Ordinance
and have requested our Sign Company to prepare the necessary drawings.

As part of the consideration of the above items, The City of Coppell, at the City's expense, is in
agreement to relocate the proposed storm drain inlet including the cost to change the existing drainage
drawings. By copy of this letter, UDS rescinds its' offer to pay for the relocation of the drainage inlet and
associated cost effective immediately. Please find attached copies of correspondence between the County
of Dallas and UDS that created this offer. I will let you notify the County of Dallas.
If the terms and conditions of this letter details the agreement of our last meeting, I would appreciate an
acknowledgment that it is accepted by the City of Coppell. Once I get this acknowledgment, we will have
the permit plans revised per our various meetings.
