RE: PRESENTATION TO THE CITY OF COPPELL PLANNING & ZONING
BOARD- 17 December 1992
FOR THE RECORD: (A synopsis of the presentation and decisions made)
Mr. Gary Seib - Director of Planning for the City stated that the City Staff recommended that
the Application for the above referenced project to be re-zoned from "Commercial" to "Office"
should be denied or rejected, based on the following nine (9) concerns:
1. "Over-building of the site" - placing too much building on to too little site.
2. "Drainage of the site" on to MacArthur Blvd.
3. "Economics of construction" - Developer may not be able to finance the project /
may not be economicly feasible.
4. "Access to the site is limited" - Automobile traffic is only available from the south.
5. "The City is against Spot Zoning" - Spot Zoning has only been approved in the City
when the Zoning Classification has been changed to a more restrictive
Classification.
6. "Project is a Non-Conforming Use" - per the City of Coppell Zoning Map.
7. "Project would set a precedent" for future requests to re-zone small parcels of land.
8. "Office Classification would have a negative impact on the existing neighborhood"
9. "The Lot #10 project is only one of three (3) such parcels of land that would
eventually be impacted" - they would also need to be re-zoned.

Formal presentation and pleas were made by Fred Cawyer, Norman Alexander, Sylvia Roberts,
Ron Roberts, and other future tenants of the "Executive Suites" tenants that would occupy
the new building. Those presenting addressed the many of the concerns noted by the City
Staff, especially the anticipated building usage, auto traffic, economic development of the
City, etc.
However, the four (4) members of the Board present - Robert Green, Marsha Tunnell, Ray
Hilderbrand and Melvin Gross unanimously voted to "deny the requested re-zoning without
prejudice". This does allow the land owner to address the City Staff's concerns and re-submit
the Application for consideration, within thc_ ne~t
NOTE: In a subsequent telephone conversation with Mr. Gary Seib on Monday - 28 December
1992, he provided the following additional information:
1. The next stage of the Zoning Re-Classification Application is to appeal to the City
Council by again formally presenting the MacArthur Court Office Building Proposed Site
Plan to the Council at their next meeting, scheduled for Tuesday - 12 January 1993
@ 7:30 pm.
2. Mr. Seib will present the City Staff's concerns, and the outcome of the previous
Planning & Zoning Board vote.., to "deny without prejudice the Application for Re-
Zoning from Commercial to Office Zoning."
3. After all presentations and additional "for and against testimony," the Council can:
A. Approve the Zoning Re-Classification (Note: The vote must be at least 6 out
of 7 members voting in favor of the request, which has only happened once
since Mr. Seib has worked for the City.
B. Deny the Application. The land-owner can re-submit after a one (1) year waiting
period.
C. Deny, without prejudice. The land-owner can re-apply with a "revised case."
D. Recommend modifications to the Application.
If the land-owner does not wish to appeal to the City Council on Tuesday - 12 January 1993,
he/she must forward a "letter-of-withdrawl of the Application" to his office as soon as
possible.

NOTE: In a subsequent telephone conversation with the Land-Owner - Mr. Mike Cooner, he
