Dear Mr. Griffin:
It is our understanding that the 21" PVC sanitary sewer originally included in the
MacArthur/Sandy Lake intersection scope of work will not be constructed. During pricing
negotiations for the MacArthur/Sandy Lake intersection change order, EBCC was directed to
maintain existing contract prices for all new areas of work that had pay items in the base
contract, even though the nature of the added work was different in character than the original
work. EBCC was further directed to distribute price increases associated with the increased
difficulty of the intersection work to the "new" bid items.
EBCC complied with these directives and distributed $37,264.00 in cost, not associated with
installation of the 21" sanitary sewer, to the 21" sanitary sewer bid item. As a result, elimination
of the 21" PVC sanitary sewer, a "new" pay item, will reduce the available dollars to construct
the intersection by $37,264.00. Please add an equitable adjustment pay item to the next change
order for $37,264.00 to compensate EBCC for these costs.
