THAT the term Grantor used herein shall be construed in the singular or plural number as such
term respectively represents one or more than one person.
THAT, TIE FREEPORT NORTH LAND U, LTD., known herein a~ GRANTOR, in consideration of
the sum ofTen and no/100 Dollars ($10.00) and other good and valuable consideration in hand paid by City of
Coppell, Texas, receipt of which is hereby acknowledged, does by these presents grant, bargain, sell and convey'
unto City of Coppell, Texas, ("GRANTEE"), the free and uninxerrupted use, liberty and privilege of passage in,
along, upon and across the following described property owned by GRANTOR (the "easement") for the purpose of
consmicting a storm sewer system across GRAN'I'OIi'S main u-act with the right and privilege at all times, of the
GRANTEE herein, its agents, employees, workmen and representatives having ingress, egress and regress in, upon
and across said premises (~he "easement") for the purpose of making additions to, improvements on and repairs to
said storm sewer system or any part thereof.
Said easement being described in Exhibits "A" and "B" attached hereto and made a part hereof' for all
purposes.
That i~ consideration of the benefits above set out, GRANTEE will remove from the easement, such
fences, buildings and other obstructions as may be found upon said property. After construction of the storm sewer
system has been completed, GRANTEE shall, except for removed obslructions, return the surface area of the
easement to its original condition as nearly as pracxicai ~aking into consideration the nature of the work bein~
p~rfonnecL GRANTORS reserve the right to use and maintain the surface of the easement for purposes which will
not inzerfere with GRANTEE'S righzs hereby granted and agree zhat upon compl~ion of &e storm sewer
improvements and restoration of be surface, GRANTEE shall not be obligated for future maintenance and upkeep
of the surface area.
TO HAVE AND TO HOLD unto the City of Copp~li, Texas, its successors or assigns for the purposes
aforesaid, the premises above described.

Being a tract or parcel of land situated in the J.T. Thweat Survey, Abstract No. 1753, Dallas County,
Texas, same being a portion of that certain 36.9891 acre tract of land conveyed to T/E Freeport
North Land Ltd. by instrument of record in Volume 94222, Page 1168, Deed Records, Dallas
County, Texas, same also being a portion of Lot 5 R out of the Replat of a portion of "Freeport
North", recorded in Volume 95245, Page 2050, Dallas County Plat Records, said tract being more
particularly described as fbllows:
Commencing at a fence post found for an interior ell corner of said 36.9891 acre tract, same being
the Southwesterly corner of that certain 214.090 acre tract of land conveyed to Angeles Esteve by
instrument of record in Volume 88246, Page 4209, Deed Records, Dallas County, Texas, same also
being in the Southerly line of said Creekview Drive, 60 feet wide, as dedicated by said Replat;
