As we discussed at the staff meeting on June 22, 1994, I am concerned about a potential consultant for
the City having a possible conflict of interest due to their employment by the City of Irving to design
a water line that will transverse the City of Coppell. The City of Coppell will be participating in the
construction cost and will become part owner of the pipeline capacity. Coppell will also participate
in the form of reimbursements to Irving for costs incurred for the maintenance of the full length of the
pipeline during its life. The terms and conditions are presently being discussed among the three cities
involved and a draft copy will be forwarded to you in the near future for review and comment.
Irving initiated this project and Dallas Water Utilities encouraged the cities of Coppell and Lewisville
to get involved and construct one pipeline to enhance the economies of scale. Since Irving initiated
this project, they retained the design consultant. However, all parties will pay their share of the cost
of the project, which will include design fees.
It should be noted that there will be a transfer of water capacity between the cities once the new
pipeline is constructed. After the transfer takes place, Coppell will take delivery of potable water from
the existing pipeline and only receive water from the new pipeline under emergency situations.
There was a joint meeting between the City of Irving, their consultant Shimek, Jacobs & Finklea, and
the City of Coppell on Friday, June 24 concerning the Irving water line. Because of my concern about
potential Charter conflicts, I specifically asked the question during the meeting about what types of
approvals the City of Coppell be required to offer in this process. The answer from Bob Chapman,
Deputy Director of Public Works was that the City of Coppell would be approving the route of the
water line through Coppell prior to the acquisition of right-of-way and would be approving the plans
for the section of the water line in Coppell. Other than those two items, the City will be approving
no permits, charging no fees, or providing any inspections on the water line.
As I stated in our meeting, the City is very much interested in having Shimek, Jacobs and Finklea
provide the design for the ground storage tank for the City of Coppell. However, we also want to be
in compliance with the City Charter so that any action we take will not be scrutinized and reviewed
in the future.
Any assistance you can give on whether or not there is a conflict with the existing City Charter would
