Mr. Bob Barbarisi, Jr. Natgun Corporation 11 Teal oad W , 01880-1292 Re: City of Coppell Village Parkway Ground Storage Reservoir No. 2 Dear Mr. Barbarisi: In our letter to you dated August 29, 1996, we directed Natgun Corporation to provide a full time superintendent that would remain on the project site at all times and coordinate the efforts of your crews and your subcontractors. This of course, is a requirement of the project specifications. On Tuesday, September 3, 1996, we visited the job site along with the City of Coppell's inspector and found work progressing on the site grading around the tank. Natgun did not have a representative on the project site. Further, from what we could gather, the work did not appear to be under the supervision of even your listed subcontractors. On this same day, we again notified you by telephone of the project superintendent requirement. Today, without a Natgun superintendent on site, work progressed at the ground storage tank. A portion of the sidewalk around the tank was poured.. You are hereby notified that Natgun Corporation is not operating within the requirements of the contract documents and that any work completed at the project site, without direct supervision by a Natgun superintendent, is rejected by the City of Coppell. This includes any work completed as of August 29, 1996. Further, the certificates of insurance you submitted for your subcontractors today, are not in compliance with the contract documents. Item 1.26 of the standard specifications requires the owner and the engineer to be named as additional insured on all applicable insurance policies. This includes the contractor's commercial general liability and the excess liability policies. In addition, the cancellation clause requirements state the owner shall be notified in writing 30 days prior to cancellation. Finally, the policy coverage for Able Service Company appears to have expired on July 27, 1996. The City of Coppell will not allow work to continue on this project until certificates of insurance meeting all the contract requirements are submitted and Natgun Corporation provides a full time superintendent on the project.
