I have reviewed our Subdivision Regulations in response to our meeting on July 14, 1994
concerning the median spacing for the potential Phillip's Lighting Development. The
Subdivision Regulations give the City Engineer authority to make minor deviations from the
Design Standards for Thoroughfares. That caveat was added with the recent adoption of the
Subdivision Regulations. Because that has been included, I would have no problem making the
call on whether or not they can deviate from 420 foot down to approximately 280 or 300 feet
for their median spacing.
The authority to allow the City Engineer to make deviations was specifically put in to handle
these types of situations on a case by case basis. Obviously, this type of authority would not
be utilized to make policy decisions that affect the City as a whole, i.e., reducing the right-of-
way requirements.
If you are comfortable with the fact that the City Engineer has the authority to make these types
of deviations, then it is my opinion that we can handle the Phillip's Lighting median spacing at
Staff level when they submit their site plan.
