RE: Schreiber Tract CLOMR, FS99-04
I have received the revised information for the Conditional Letter of Map Revision for Denton
Creek for the referenced Schreiber Tract. During the initial review by Albert Halif, comment
number I-D review stated that the Section 404 Wetlands Permit should be addressed. This was
because there appeared to be a pond in the general vicinity of the fill. In your response to that
comment, you stated that wetland issues will be addressed during site development.
Please be advised that the report cannot be approved by this office, nor submitted to FEMA for
approval until the wetland issue has been resolved. If in fact the wetland issue impacts the
placement of the fill and or the mitigation of the weftands requires less ~l, then the study itself
would be invalid prior to implementation.
The City's Floodplain Management Ordinance 94639, Section C, Paragraph Seven, states that
all necessary permits should be obtained from the Federal, State and other local governmental
agencies, including Section 404. Section C is the section which governs the issuance of a
floodplain development permit, which is necessary prior to any fill or reclamation taken place.
Obviously, if wetlands on the site impact the flU, then as previously stated, the study could be
invalid. Therefore, please be advised that the 404 weftands issue will need to be addressed
prior to processing this report any further.
