Re: Denton Tap Road Improvements - GTE utility adjustments
Dear Mr. Ratliff:
We have reviewed the attached letter and discussed the matter
with GTE. The point of contention is the LOWERING of GTE's duct
system in the area of Grapevine Creek. As you are aware, we are
replacing the bridge structure on Denton Tap Road at this
location. We have designed two new bridge structures at this
location which must, and do, conform to the City of Coppell
Floodplain Management Ordinance and the National Flood Insurance
Program requirements. In order to accomplish the aforementioned
design, it is necessary to modify the creek channel both upstream
and downstream of the new bridge structures. As currently
installed, the GTE facilities will be exposed when the channel
ne
modifications are completed, and therefore it is
GTE to LOWER their facilities in their CURRENT~horizontaI~
location.
We have coordinated our design efforts with GTE over the last
year and a half, and all parties have been kept abreast of
progress. The lowering of GTE's facilities in this area has been
discussed between their engineering department and this office
for at least one year, and therefore it is not a new orW
unanticipated issue. In my telephone conversation with the GTE
engineering department yesterday, GTE reiterated their position
that they will proceed with their work while the issue' of who
pays for the lowering at Grapevine Creek is being considered, in
order not to delay the construction of Denton Tap Road.
The cost estimate that they have provided does not seem to be out
of line with nature and scope of work they must do to lower their
facilities at Grapevine Creek. Although we have no copies of
GTE's private easement in this area, we agree that some of their
facilities appear to be outside of the R.O.W. of Denton Tap Road
in this area. We have no way of ~owing whether the City of
Coppell. should pay any or all of the costs associated with GTE's
lowerings and suggest that you ask the City Attorney to review
GTE's Franchise Agreement with the City of Coppell and render an
opinion in this matter.

As mentioned above, I discussed this matter with GTE yesterday in
a telephone conversation, and they do not have an adversarial
attitude in this matter and they do seem to want to cooperate
with the City of Coppell in resolving this matter.
