KNOW ALL MEN BY THESE PRESENTS
THAT the term Grantor used herein shall be construed in the singular or plural
number as such term respectively represents one or more than one person.
THAT, CATELLUS DEVELOPMENT CORPORATION
, known
herein as GRANTOR, in consideration of thc sum of One and no/100 Dollars ($1.00) and other
good and valuable consideration in hand paid by City of Coppell, Texas, receipt of which is
hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of
CoppeH, Texas, ("GRANTEE"), the flee and uninterrupted use, liberty and privilege of passage
in, along, upon and across the following described property owned by GRANTOR (the
"easement") for the purpose of constructing utility improvements across GRANTOR'S main tract
with the right and privilege at all times, of the GRANTEE herein, its agents, employees,
workmen and representatives having ingress, egress, and regress in, along, upon and across said
premises (the "easement") for the purpose of making additions to, improvements on and repairs
to said utility improvements or any part thereof.
Said easement being described in Exhibits "A" and "B" attached hereto and made a part
hereof for all purposes.
That in consideration of the benefits above set out, GRANTEE will remove from the
easement, such fences, buildings and other obstructions as may be found upon said property.
After construction of the utility improvements has been completed, GRANTEE shall, except for
removed obstructions, remm the surface area of the easement to its original condition as nearly
as practical taking into consideration the nature of the work being performed. GRANTORS
reserve the right to use and maintain the surface of the easement for purposes which will not
interfere with GRANTEE'S rights hereby granted and agree that upon completion of the utility
improvements and restoration of the surface, GRANTEE shall not be obligated for future
maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns
for the purposes aforesaid, the premises above described.

BEING a 350 square feet (0.0080 acres) tract of land situated in the S.A. & M.G. Railroad Survey,
Abstract No. 1439, Dallas County, Texas, and being part of Lot 1, Block 1 of Gateway Business Park,
an addition to the City of Coppell as recorded in Volume 96129, Page 3135, Map Records, Dallas
County, Texas, and being more particularly described as follows:
COMMENCING at a 5/8" iron rod set for corner situated in the intersection of the north line of Cotton
Road (65' R.O.W.) and the northeasterly line of I.H. 635 (LBJ Freeway)(variable width R.O.W.);
THENCE N54°44'53"W, along said northeasterly line of I.H. 635 (LBJ Freeway), a distance of 411.18
feet;
THENCE N35° 15'07"E, leaving the northeasterly line of I.H. 635 (LBJ Freeway), a distance of 10.00
feet to a point on an existing 10 foot utility easement as recorded in Volume 82100, Page 2865 and
Volume 90138, Page 4289, Map Records, Dallas County, Texas and also being the POINT OF
BEGINNING;
THENCE N54°44'53"W, along the existing 10 foot utility easement, a distance of 15.00 feet;
THENCE N35°15'07"E, leaving the existing 10 foot utility easement, a distance of 23.29 feet;
THENCE S54°44'53"E, a distance of 15.00 feet;
THENCE S35°15'07"W, a distance of 23.29 feet to said point being in the existing 10 foot utility
easement, also being the POINT OF BEGINNING and containing 350 square feet or 0.0080 acres of
