KNOW ALL MEN BY THESE PRESENTS
THAT the term Grantor used herein shall be construed in the singular or plural
nomber as such term respectively represents one or more than one person.
THAT, CATELLUS DEVELOPMENT CORM. ORATION
, known
herein as GRANTOR, in consideration of the sum of One and no/100 Dollars ($1.00) and other
good and valuable consideration in hand paid by City of Coppell, Texas, receipt of which is
hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of
Coppeil, Texas, CGRANTEE"), the free and uninterrupted use, liberty and privilege of passage
in, along, upon and across the following described property owned by GRANTOR (the
"easement") for the purpose of constructing utility improvements across GRANTOR'S main tract
with the fight and privilege at all times, of the GRANTEE herein, its agents, employees,
workmen and representatives having ingress, egress, and regress in, along, upon and across said
premises (the "easement") for the purpose of making additions to, improvements on and repairs
to said utility improvements or any part thereof.
Said easement being described in Exhibits "A" and "B" attached hereto and made a part
hereof for all purposes.
That in consideration of thc benefits above set out, GRANTEE will remove from the
easement, such fences, buildings and other obstructions as may be found upon said property.
After construction of the utility improvements has been completed, GRANTEE shall, except for
removed obstructions, return the surface area of the easement to its original condition as nearly
as practical taking into consideration the nature of thc work being performed. GRANTORS
reserve the right to use and maintain the surface of the easement for purposes which will not
interfere with GRANTEE'S fights hereby granted and agree that upon completion of the utility
improvements and restoration of the surface, GRANTEE shall not be obligated for future
maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assi~s
for the purposes aforesaid, the premises above described.

BEING a 203 square feet (0.0046 acres) tract of land situated in the S.A. & M.G. Railroad Survey,
Abstract No. 1439, Dallas County, Texas, and being part of Lot 1, Block I of Gateway Business Park,
an addition to the City of Coppell as recorded in Volume 96129, Page 3135, Map Records, Dallas
County, Texas, and being more particularly described as follows:
COMMENCING at an iron rod found for corner situated in the south line of Gateway Boulevard (70'
R.O.W.);
THENCE along the curving south line of said Gateway Boulevard a delta of 03°49'33", a radius of
785.00 feet, an arc length of 52.42 feet, and a chord bearing and distance of N89°41 '31 "W, 52.41
feet to a point;
THENCE S02° 13'15"E, leaving the south line of Gateway Boulevard, a distance of 10.00 feet to a point
on an existing 10 foot utility easement as recorded in Volume 90138, Page 4289, Map Records, Dallas
County, Texas and also being the POINT OF BEGINNING;
THENCE S62° 16'35"W, leaving the existing 10 foot utility easement, a distance of 29.64 feet;
THENCE N27°43'25"W, a distance of 13.39 feet;
THENCE along the curving south line of said existing 10 foot utility easement, a delta of 02°24'17",
a radius of 775.00 feet, an arc length of 16.27 feet, and a chord bearing and distance of N86°34'36"E,
