Waiver of Impact Fees for Havertys Furniture

I recently received a request from Havertys Furniture (copy attached) for a waiver of Roadway
Impact Fees. Based on the contents of the letter, it appears as though Havertys does not have
a clear understanding of the waiver of the Roadway Impact Fees. The first paragraph seems to
lead me to believe that Havertys anticipates a 100% waiver of their impact fee. The second
paragraph leads me to believe that Havertys is anticipating some credit for the construction of
a cul-de-sac.
On the first issue, they are correct in stating that Catellus constructed various roadways within
the Gateway Business Park. Some of those roadways are included on our Thoroughfare Plan,
therefore they could be eligible for up to a 75 % waiver of the impact fees. However, before
we can establish a "bank" to start providing offsets, we need information from Catellus stating
the exact cost of the improvements and the right-of-way.
On the second issue concerning the cul-de-sac, the only roadways which we give credit for are
roadways on the Thoroughfare Plan or roadways that serve as a collector street to the
Thoroughfare Plan. Obviously, a cul-de-sac would not fall under either of those categories, so
in my opinion, no credit could be given to Havertys for the construction of the cul-de-sac.
With this memo, I am attaching a draft letter to Havertys basically laying out the items the City
requires before the final approval of the waiver of the impact fees could be provided.

Waiver of Roadway Impact Fees

Dear Mr. Schmidt:
The City of Coppell has received and reviewed your request for a waiver of Roadway Impact
Fees pursuant to the development of the Havertys Furniture Store in the Gateway Business Park.
Let me state that you are correct in assuming that there could be some wavier of Roadway
Impact Fees. Based on the roadways constructed, that waiver would be 50% or 75 % of the total
required impact fees. Before the City can make it f'mal determination and expedite this request,
the following information is needed: 1) Information should be provided from Catellus outlining
the actual cost of the roadway and the cost of the associated right-of-way with the roadway.
That breakdown of cost provides the City with a basis for establishing a "bank" to allow offsets
credits against Roadway Impact Fees for the various developments within the Gateway Business
Park; and 2) Catellus should provide an assignment of a portion of the "bank" to Havertys
Furniture Company.
The only roadways that are eligible for an offsetting credit are roadways that are identified on
our Thoroughfare Plan or collector roads that connect various thoroughfares. Therefore while
you are constructing a cul-del-sac on this site, the construction cost and right-of-way associated
with that cul-de-sac is not eligible for any offsetting credit to the roadway impact fees.
In summary, let me state that you are eligible for either a 50% or 75% reduction in your
Roadway Impact Fees depending on the information to be provided to the City by Catellus
concerning the construction of the roadways.

Re: Waiver of Roadway Impact Fees
Dear Mr. Griffin:
We hope to soon close on an acquisition of 26 acres from Catellus Development Corporation in their
Gateway Business Park. If current plans hold, we will start earthwork construction before the month
is out. The first phase of our development will include approximately 223,000 square feet of
warehouse and distribution space, 50,000 square feet of retail space, and our regional headquarters.
In working with your staff, we have calculated the roadway impact fees associated with the
development to be approximately $93,000. In earlier discussions in the site selection process, Felix
deGolian was advised by various members of the city staffthat a waiver was available, since the
roadway improvements were already in place. By this letter, we now request a waiver of this roadway
impact fee.
Our rationale is based upon the fact that the property owner, Catellus, has installed the improvements.
By our purchasing the land from Catellus, we, therefore, gain the benefit of those improvements so
that the waiver should be available to us. Secondly, as a part of this development program, we are
installing a new 500 foot long cul-de-sac at an approximate cost of $125,000. This road, Exchange
Place, will be constructed to city standards and dedicated to the city. Its entire cost will be borne by
Haverty Furniture Companies, Inc.
Our general contractor is Hill and Wilkenson. We expect them to apply for permit soon. What fees
must be paid at that time? Can this waiver be granted prior to then? We appreciate the help you and
your staff continue to provide. We're looking forward to operating our new facility in Coppell.
