RE: Gateway Business Park II
Dear Mr. Bryan,
This letter is written as a follow-up to your January 29, 1998, letter requesting that a "bank" be established to
offset the future Roadway Impact Fees for development for what is referred to as Gateway Business Park II. I
am viewing Gateway Business Park II as the area of land owned by Catellus that is not included in the original
Gateway Business Park.
As you may be aware, the ability to offset portions of the Roadway Impact Fee was only available to land zoned
LI and west of the Denton Tap/Belt Line Roadway. The land on which the Lucent Technology facility is being
constructed is in an area zoned Highway-Commercial. Therefore, offsets to the Roadway Impact Fee were not
available to it.
On February 24, 1998, Council approved a resolution amending a portion of the Roadway Impact Fee Ordinance
to allow offsets and credits for property west of Denton Tap/Belt Line that is being developed as a use allowed in
the LI District. In other words, even though the property in question is zoned HC, the use is one that is allowed
in an LI zoning. Therefore, offsets and credit against the Roadway Impact Fee are now allowable.
A bank in the amount of $1,933,666 is being established to help offset the required Roadway Impact Fees in the
Gateway Business Park II. Both of the roadways which you are requesting credit for, Freeport and Wrangler, are
on the City's Thoroughfare Plan. Therefore, credits in the amount of 75% against the Roadway Impact Fee could
be authorized against each development in the Gateway Business Park II area until such time as the "bank" of
credits has been exhausted. In other words, with each development, only 25% of the assessed Roadway Impact
Fee will be due.
