The Engineering Department was contacted by the Police Department via memorandum (see attached memo
dated May 14, 1999) indicating the need for speed limit signs on S.H. 121. As described in the memo, our
courts overturned a speeding ticket on southbound S.H. 121 because there are no speed limit signs located
within the Coppell city limits. Subsequen~y, any speeding citation issued along S.H. 121 within Coppell will
automatically result in a Not Guilty finding.
The Engineering Department contacted Texas Department of Transportation (see attached memo dated June
1, 1999) regarding this issue and was told that a speed study would be performed to determine the proper
speed limit along this section of highway. The study has been completed and the attached letter dated August
17, 1999 illustrates that the appropriate speed limit within Coppell is 55 mph. The letter also indicates that a
signed ordinance from the City establishing this speed limit is needed before installation of the new signs.
Staff recommends approval of this ordinance and will be available for questions at the Council meeting.

Subject: Speed Limit Sign S.H. 121 99-16
On 05/13/99 Officer Gonzales presented a speeding case to City Court. The alleged offense
was 70/55 on 5/B S.H. 121. The evidence presented to the Court by Officer Gonzales and
by the defendant led to a Not Guilty finding by Judge Mosley. The reason for the Not Guilty
finding was that there was no 55 mph speed limit sign for south bound traffic on S.H. 121 in
our City.
I will contact Tx D.O.T. and request a speed limit sign be placed at the start of our City
limits on S.H. 121. With the case law made on 05/14/99 in the CoppeLt Municipal Court,
any speeding citation issued on S/B S.H. 121 by our Officers will automatically result in a
Not Guilty finding.
I attempted to call Tx. D.O.T. and after speaking with 3 people I was transferred into Keith
Neighbors (1-940-387-1324) voicemail. I left a message with him abollt the Sign.

The Coppell Engineering Department was rtenfiy contacted by our Police
Department regarding enforcement of the speed libnit on 811121. Attached is a
memorandum indicating that our courts have ruled that we need to have the speed limit
posted within our city limits in order for citations from our Police Department to be lawful
and upheld in court. I am including a map indicating the portion of SH121 that lies within
the Coppell City Limits and the desired location of the speed limit sign. My understanding is
that the signing is needed in the southbound direction only. If you have any questions

AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 8,
ARTICLE 8-1, SECTION 8-1-3 TO ESTABLISH THE MAXIMUM PRIMA
FACIE SPEED LIMIT FOR STATE HIGHWAY 121 IN THE CITY LIMITS
OF THE CITY OF COPPELL; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE
SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. That the Code of Ordinance of the City of Coppell, Texas be, and the same
is hereby amended by amending Chapter 8, Article 8-1, Section 8-1-3, in part to add the following
designated speed limit for State Highway 121, to read as follows:
"Sec. 8-1-3. Speed on Specific Streets
STREET PORTION OF STREET SPEED MILES PER HOUR
State Highway 121 State Highway 121
within the City limits .....................................................55"
SECTION 2. That the Director of Traffic Control shall cause to be erected appropriate
signage giving notice of the speed limit established herein.
SECTION 3. That all provisions of the Code of Ordinances of the City of Coppell, Texas,
in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other
provisions not in conflict with the provisions of this ordinance shall remain in full force and effect.

SECTION 4. That should any word, phrase, paragraph, section or phrase of this ordinance
or of the Code of Ordinances, as amended hereby, be held to be unconstitutional, illegal or invalid,
the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof
other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the
validity of the Code of Ordinances as a whole.
SECTION 5. An offense committed before the effective date of this ordinance is governed
by prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense
was committed and the former law is continued in effect for this purpose.
SECTION 6. That any person, firm or corporation violating any of the provisions or terms
of this ordinance or of the Code of Ordinances, as amended hereby, shall be guilty of a
misdemeanor and upon conviction in the Municipal Court of the City of Coppell, Texas, shall be
subject to a fine not to exceed the sum of Two Hundred Dollars ($200.00) for each offense, and
each and every day such violation is continued shall be deemed to constitute a separate offense.
SECTION 7. That this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and charter in such cases provide; however the speed
limit established herein shall not take effect until the appropriate signage giving notice of such
speed limit has been erected.

RESOLUTION NO. 181099.3
A RESOLUTION OF THE CITY OF COPPELL, TEXAS, SUPPORTING THE USE OF
THE STATE INFRASTRUCTURE BANK TO EXPEDITE THE DEVELOPMENT OF
SH 121 MAIN LANES FROM THE DENTON/COLLIN COUNTY LINE TO DFW
AIRPORT.
WtlEREAS, the City of Coppell, in conjunction with Denton County and the SH 121
Task Force has worked diligently and in collaboration with the Texas Department of
Txansportation since 1986 to create an East-West thoroughfare linking traffic from one of the
State's fastest growing regions to the Dallas/Fort Worth International Airport; and
WHEREAS, the constituent members of the SH 121 Task Force have experttied
significant effort and financial resources to acquire approximately Thirty Million Dollars
($30,000,000) of fight-of-way and to conduct various analyses, plans and studies; and
WHEREAS, the Intermodal Transportation Efficiency Act of 1991 and the
'iransportation Equity Act for the 21st Century authorized and funded the establishment of the
Sta~c 1..,,.frastructure Bank; and
WHEREAS, the State Infrastructure Bank was established to advance the development
and construction of critical roadways of regional significance; and
WitEREAS, the City of Coppell prefers the freeway option over the development of SH
121 as :t toll facility and is willing to provide funding to offset a portion of the cost to Denton
County; and
WHEREAS, any further delay in the construction of the SH 121 Bypass main lanes will
only serve to exacerbate the negative effects of regional hyper-growth and congestion while
hampenng the clear opportunity to reap the full benefits of economic development.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF COPPELL, DALLAS COUNTY, TEXAS:
]'hat the City of Coppell supports the expedited development of the SH 121 main lanes through
the use ot the State Infrastructure Bank loan process and encourages the Texas Department of
Transportation to take the necessary steps to ensure that construction of SH 121 begins in 2004.
