Lakeside V2-CS 960723 (2) · PoO. Box 478 Coppell, Texas 75019 The City With A Beautiful Future 214-462-0022 July 23, 1996 Raul Pena III, P.E., Vice President IBM Engineers & Planners 500 West Seventh St., Suite 600 Fort Worth, TX 76102 RE: Kroger Project Dear Mr. Pena: This letter is written as a follow-up to the July 19, 1996 letter in which you request clarification on future usage of easements across the face of the Kroger plat. Our restrictions to improvements in the easement does not preclude paving across the easement. This language is generally inserted to insure that no future structures or objects are constructed that cannot be moved if the underlying utility has to be accessed in the future for maintenance purposes. In our easements we generally allow paving, fencing and sometimes landscaping if it is not a visibility obstruction. We do not allow structures of any kind, nor do we allow additional utilities to go into easements specifically dedicated to the City without the City's prior consent. If you should have any additional questions please feel free to contact me at your convenience. Sincerely, Kenneth M. Griffin, P.E. Assistant City Manager/City Engineer file/kgriftin/kroger.796
