Dear Mr. Griffin:
We transmitted mylars and original bluelines of the final plat to the City on July 18 for final
signatures in order to start the process for recording the plat. Also on this day, we forwarded one set
of as-built drawings to Mike Martin for review.
Kroger has one concern regarding the wording on the face of the Kroger plat. The dedication
statement mentions that no improvements can be constructed across easements. Examples of
improvements are noted as buildings and structures; however, "other improvements" are also
prevented from being constructed across easements. As you know, this project has paving
improvements across these easements. Kroger is concerned that the strictest interpretation of "other
improvements" would some day prevent repaying or other access-related improvements across these
easements. Would it be possible for your department to write a letter clarifying that "other
improvements" does not include paving/access improvements? If you have any questions, please
