S-e aR I disagree with the characterization that no work has been taking place along Sandy Lake Road during f i `Pw S the summer months. Based upon the schedule dated May 17, 2000, EBCC has completed the storm sewer activities in phase 3, the majority of the work in phase 2, and the 30" water line extension and HMAC repair in phase 9. The delay switching traffic between phase 2 and phase 5 is directly I ,� t attributable to the GTE conflicts with the water line extension experienced by our utility subcontractor. The delays starting dirt work for phase 4 are directly attributable to the difficulties encountered by our � ,,,,5 wall subcontractor regarding the retaining wall at Heartz. � , JGV , ' 1 ' 4 The May 17, 2000 schedule indicates that the paving on south side of Sandy Lake from Moore to MacArthur (phase 5) is the critical phase that will allow timely completion of the remainder of the project. Our crews switched traffic to start that work on September 14, 2000. Starting this phase has been delayed because of GTE conflicts with the 30" water line extension which have prevented completion of the detours necessary to switch traffic, thus making the phase 5 work available. Based upon tlic actual Start date for the phase 5 traf Ic switch and the addition of the MacArthur intersection, I have revised the project schedule and enclosed a copy of that schedule for your records. The enclosed schedule reflects timely completion of the project and can be executed if the City of Coppell ensures that the franchise utilities clear the ROW and the City of Coppell procures all of the ROW necessary to complete the project. Currently, there are conflicts between the proposed improvements included in phase 5 and the utility poles near the Sandy Lake /MacArthur intersection that need to be cleared immediately. Prior conflicts have eliminated all available float time from the schedule. There are no additional phasing options available to compensate for future utility conflicts. All future conflicts will negatively affect the project schedule. �) = I am certain that you would agree that conflicts with franchise utilities on this project have had a J Q gk substantial negative impact on this project. Based upon the tone of your letter, it is clear that the City doesn't appreciate the effort to continue to progress a project that shouldn't have been started prior to relocation of existing utilities. It is our intent to continue to progress the project despite the continued existence of known utility conflicts. We would expect the City to aggressively coordinate the relocation of known conflicts, such as the utility poles on the south and north side of the MacArthur /Sandy Lake intersection that will prevent the construction of the MacArthur intersection and the fiber optic line that is preventing construction of the wall at the Heartz /Sandy Lake intersection. 4 With regard to the remaining concerns noted in your letter: A , ,e 1. Paving from Denton Tap to Moore: Based upon the information provided in your letter, observations at sawed edges of the new pavement, and the compressive strength test results provided by your testing laboratory, we do not believe that the integrity or strength of the pavement is an issue of h. concern. The problem appears to be l ocalized surface imperfections that can be corrected with an epoxy,.,;; , , grout or surface grinding. The surface voids are probably caused by small unconsolidated pockets of 14? n cement /sand paste that rise to the surface during consolidation of the concrete. The surface spall at the Moore intersection was caused by too much surface water utilized during finishing. It appears that this problem occurred at the edge of a hand finished area. Entry Signs at Allencrest and Woodcrest: It appears that bid item #4 will be eliminated if your agreement with the HOA is successful. The bid item includes the removal of the entry signs and we have removed the two signs in question. Our price for removal of the entry signs is $1,000.00 per location. 3. Claims: We are aware of one claim regarding vehicles striking guard rail. That claim was filed on November 7, 1999 from Bruce MacDonald and was denied. If there are other outstanding claims, please provide a list of claimants and EBCC will provide your office with a status of those claims. IA- 4. Street Signs: Our project coordinator a, gn p j or has spent an inordinate amount of time straightening signs at the request of the City. i The vast majority of this work has had nothing to do with our contract with he City. The missing signs are predominately the result of vandalism. The vast majority of the sign straightening has been the result of local business traffic and construction deliveries that are not -t , associated with our project. I agree that EBCC needs to take care of the signs removed and replaced y EBCC; however, we are not responsible for signs destroyed by vandalism or the traveling public. 5. Temporary Roadway: We will comply with your directive regarding temporary pavement transitions. Page 3 Sandy Lake Road Re: Revised Schedule 6. Heartz Wall: It is my understanding that a fiber optic cable, overhead TXU lines, and an existing tree are preventing completion of the wall as per the plans and that the City has denied any efforts to modify the wall to allow construction at this location. The problem with the overhead TXU lines can be resolved by utilizing a shorter drill rig. The existing fiber line will need to be relocated prior to the drill shaft work at this location. The City will need to secure a construction easement and authorize removal of the tree from private property prior to completing excavation for construction of this wall. All of the stated problems can be averted, if the elevations of the drill shafts are raised; however, raising the elevation of the drill shafts will decrease the pay quantity for the wall. If this option is chosen, then the price for the wall will need to be revised. This conflict is delaying phase 4 of the project. Please provide guidance regarding resolution of this issue. 7. Brick fascia on walls: It is our understanding that the brick samples were approved and returned to our project coordinator with the caveat that we needed to match the color of the existing pavers. According to our subcontractor, the existing pavers have faded and that color cannot be matched with new pavers. As a result, the wall fascia has not been approved and the work cannot be started. With regard to the schedule, our subcontractor is prepared to start after the brick fascia has been approved and manufactured. We will contact your office to schedule a meeting to discuss the Heartz wall and the brick fascia. 8. Project Manager status: Your information regarding changes in personnel is incorrect. Gary Pryor is still the project coordinator and I am still the project manager for this project. Both Gary and I have the same authority that we have always had regarding this project.
